Howie, WTKK may appeal; Entercom responds (Herald)

they state what's written in a legally binding document called a service contract which he allegedly signed.
his attorneys obviously didn't properly interpret all the provisions which happen to be part of his contract.
even worse, they went back in front of a judge who already ruled against him once. brilliant. now, that judge did it twice. brilliant. maybe they should request the same judge for his appeals process just so they can strike out three times and be totally out. absolutely brilliant. kind of like that baseball team which would cut into last 36 minutes and 10 seconds of his show.

whoeve(it sounds like moe, larry and curly) is advising howie is doing one dreadful job of it. he should ask for all his money back, plus interest. lucky for him, he still has a newspaper gig which allows him to recycle all his old columns and replace names of mobsters and hacks.

I understand there's the Mass. Appeals court, and the Supreme Judicial Court. Or maybe they can
try to work out a monetary deal between the two parties that would allow an exit for Howie. But
Entercom might not even think about doing that.

Unfortunately for Howie, the time for interpreting the contract correctly was before he signed it. It is now being interpreted by a judge.

Which may or may not elect to take the case. And on what basis is the appeal? I don't think he's going to try the indentured servitude route again. The non-compete agreement, which was ruled invalid, was invalidated while Howie was working under his old contract, and was a red herring (despite what Jessica told you) because Entercom's case was based on the match provision, which is legal under Mass law. If you think an appeals court is going to throw that out to save Howie from his own negligence, you may be in for a long wait.

Interestingly, Howie never mentioned the match provision in his PR campaign, probably because he realized he was screwed and so tried to position it as a non-compete issue, which he knew was a guaranteed winner. I'm sure you were as surprized as I was that Maloney's WRKO 'insiders' never tipped him to what the real issue was ;D

Plus, if Howie appeals and loses again (which is the most likely outcome), he could be held liable for monetary damages to WRKO during the appeals process. Exactly how much money to you think Howie wants to flush down the drain. This is not a freebie.

So just what do you think is appealable about this ruling. Be specific.

Well, Howie can't afford to buy his way out of his contract, and I'm not sure that GM wants to deal with Entercom in a situation where Entercom holds all the aces. Imus in the wings may be the only card that GM holds.

As a Howie fan, you may want to delay reprogramming that 680 preset.

wtkt's line-up is even more unappealing. the poor guy from swellesley has been cursed by imus. should've stayed back in his element at wrko. mike from fitchburg stepped aside just so his best buddy the evil imus could set howie up. howie fell for it because of greed. the grass always looks greener on the other side. evil imus even made les and sumner pay 20 mil for a bit that he didn't even write. imus 2, howie 0.

wrko doesn't have much to worry about if howie wants to hold out for another five years. they will let him sit and wait. they're smoking wtkk out in the ratings. the only one who can save wtkk now is imus, not howie.
 
Yeah it looks like Carr's fortunes have turned just as the Red Sox's have. As I've said I listen to Laura I.
and that's about it on 96.9; surely I'd tune in for Howie if they get him.
It would be interesting to see WRKO's ratings show by show. How is the Felon doing? I have a hunch
Rush, Howie, and the Sox are the reasons for whatever number they have. The past numbers (12 plus)
that just came in don't include Howie who left the day before this period, right? But he's been part
of their success before. Still, if Howie is gone for an extended period (or forever) will they drop?

Didn't WTKK go down in the period where Severin was in limbo? Now he's back..and the ratings continue
to drop.
