Congratulations on taking such a bold stance against protesting the CRB rates, but I'm wondering what you're going to tell your listeners when you're forced to go off the air when you can no longer afford to broadcast? Today you have an opportunity to allow them to petition on your behalf and you're going to soldier on as though there's nothing wrong?

If I were a regular listener (and I might be, now, as I am thoroughly enjoying the stream today) I would feel rather jilted if this happened and I had missed the chance to speak out to keep you on the air. Please reconsider your position and let your listeners know what a dire position you're in if these rates pass.
 
Let me speak on behalf of Hy for a moment if I will. Aside from being all lawyered up, I’d like to suggest that no one can supersede the historical capacity Hy represents to the industry where his pioneering broadcast and communication medium interests are concerned. For any entity to represent that they can, inhibit, impair, tax, warrant, or otherwise impede, particularly retroactively any capacity diametrically contrary to Hy’s communicative investment interests, is laughable, and perhaps on a judgmental basis, liable.

Are you suggesting that Hy will refuse to pay the new CRB rates for his stream when they come out? Or do you care to provide an alternate translation for what you just wrote?

(just a joke, my friend.... Hy Lit is still my idol) PS I remember hearing you and your dad on WKXW back in 1980 when I still lived in Jersey...
 
I am now a Mobile DJ in West Virginia...I spent about 30 years behind the Microphone as a Radio DJ in Various Formats..I spent a brief amount of time in the Delaware Valley in the late 60's as a Teenager and without question Hy Lit was one of the inspirations in the Career Path I chose..About a year ago Hy spoke to me by E-Mail about possibly considering working for him in Clubs in the Philly area..Obviously that is impossible as I am established here and quite busy but if I were younger I might have considered it..It would have been an honor..I have also turned a few local folks originally from the Delaware Valley onto Hy Lit Radio...Needless to say,I am a Regular Listener.
 
i learned if you want a radio show you must pay the price the owners ask and one day soon i wlll be back on the air in the philadelphia market stay tuned

"HERO" IN THE EARLY 60'S) (STILL ONE OF MY ABSOLUTE FAVES) , if you think , or your awesome dad , for that matter , that hy's fantastic reputation would change the money world of internet audio streaming , since your dad is the best , you have another thing coming , and you , as a lawyer , should know that more than anyone .... profits , in a larger sense , when bringing more shares being bought on "wall street" , have , UNFORTUNATELY , NOTHING TO DO WITH QUALITY AND ETHICS AND REPUTATION AND INTEGRITY ... phew , i wish i was wrong , but unfortunately , in this hard cold business world , i am correct

Sam, even with the horrible grammar and punctuation, this man speaks the truth. It doesn't matter how good your lawyers are, or how far above the game Hy believes himself to be. The rules apply to everybody, and you guys are running a music stream just like Live365, Yahoo, and all the local stations in town. You will have to pay the elevated fees just like everyone else. And I highly doubt that you and your father will find the internet radio business to be very lucrative after those new fees go into effect.

You had a great chance to ask your listeners for their support. In fact, your target audience is one of the most politically active groups in the country - they would drop everything to write letters and call their representatives on your behalf. Why you refuse to mobilize this group, thinking that you won't have to pay the new stream fees, is beyond me.
 
A case of "Because I can."

Some have their own self-interests and not in the "business" of welfare for others.

Mr. Lit's sterling career will have no play when the Sound Exchange bot comes visiting and says, "Pay those CRB Royalties, yet, Hy?"

This isn't about being a rebel. Maybe it's more of "I haven't done anything wrong unless I get caught."

I'm a regular listener to www.HyLitRadio.com and I enjoy it. Great music, voice tracks and many fine jingles ... a tribute to a great air talent.

Why should he support us? We are, after all, "competition." Did WIBG "support" WFIL? Hell no. Why, then, now?

But to flaunt it on the web thread as he and his son did was a bit over the top. And the "answering" response was, if nothing else, lame.
 
If this comes to play,Does Hy Lit Radio not have enough of a listener base to support a Subscription Based Model?....It also seems I read just a few weeks ago that Internet Webcasters were being given a temporary reprieve from all this.
 
I don't believe the operative "pioneer" means squat when determining this issue. No webcaster, including those a lot larger than you, is "grandfathered" by law.

And I know many "pioneers" in terrestrial and internet broadcasting, Sam, that, like you should be, pay royalties to ASCAP, BMI, SESAC and to SoundExchange. In a few days, a performance "royalty" fee will put stations out of business ... whether they make money or not ... including, one would think, HyLitRadio.

No exceptions, according to my three elected representatives ... and two are sponsors of the equality bill.

Incidentally, since you can't seem to be found you on Loud City or other "legal" stream, like Live365 that pays ASCAP, BMI & SESAC licensing, just how do you do it?

Is that "pioneer" effort at work with separate deals with composers and publishers? That's a lot of work, for sure.

And about that letter...rumor has it that that was you and not your dad...otherwise, the "response" you gave would have been a lot more direct.

Pioneer, indeed. Tell that to "Paradise Radio." Now, there's a "Pioneer." And he pays fees like I'm sure you do.
 
Y’know, it may not be necessary to direct your agitation with this issue at me, or Hy for that matter. Upon closer examination, you may find that our position on this issue may define and ultimately set measures of precedent in favor of the independent broadcast interests. However, your fixation with the suppositions on this issue apparently leaves you with this shortsighted agitated view. If you can’t define the word ‘pioneer’ in it’s proper context, then I suggest you research its meaningful capacity and perhaps then you can put this dialog to good considerable use, and go beyond saddling me with self serving interest parameters

What give you the right to be different than everyone else in the webcasting "business?"

A little more clearer and defining as to your role, not my supposed agitation with your "head in the clouds" attitude, would be a lot more welcome. Your dad is a radio DJ legend, not a "pioneer" of broadcast licensing.

If there is nothing to hide, just say it honestly like it is ... then go about the business of providing good radio as we as webcasters are "expected" to do by law, not as some self-aggrandizing "legendary" status as a "pioneer" who feels, and responds, above it.

Again, the basic question asked here: Are you paying required licensing fees or not? That simple.
