Is WBRO (Marengo, Indiana) 89.9 on the air?

A simple question ... this station came up in conversation yesterday and it apparently has a website (with a broken streaming connection). Anyone in the Marengo/English metropolitan area :) hearing this station?
 
False. WBRO is not a pirate. Years ago at license renewal time there was a glitch
in the FCC's electronic filing system. The FCC made a mistake and cancelled the
licenses of both WBRO and WBAA at Purdue.

WBAA had an expensive lawyer and the FCC corrected it's mistake and admitted it.
It's the same case with WBRO. It's time to shake the bushes at the FCC. Yes WBRO
does have permission to be on and has filed it's renewal.
 
This is so odd. With WBAA they admitted they didn't file their License renewal and the FCC allowed them to refile after renewal time.

WBRO has been de-listed for some time. If the FCC allowed them to file late there would be some note on the website. I can't even find their information on the FCC site or any information they refiled.

The only difference is Purdue had an attorney.
 
That is the question that came up in my off line conversation ... WBRO is in the FCC's system as DDWBRO ... a deleted call sign. (although why the double d?)

They had a STA back in 2006 that expired in December. Their license was canceled as of June 2006.
Their license renewal in 2006 should have been filed in 2004 (with the rest of the stations in Indiana).

They certainly need a lawyer to get this straightened out. Until then it seems that they are just a 1kw pirate.
(There is no excuse to be operating without qualified legal counsel - and a clear license.)
 
OK let's go just one more time. Hope you get it. WBAA and WBRO filed license renewals in 2004, on time.
There was a glitch in the FCC's new filing system that kept them from
processing timely filed NCE applications. These stations then refiled in
2006. For some reason, in almost 2010, the FCC has still failed to act
on the WBRO renewal.

I have never seen anything like this. The FCC is well aware this station is
on the air.

I made some harsh statements just like Lurker on this very case in the
past. Then, the FCC admitted in a National News Story that their filing
system was screwed up and it was not WBAA's fault.

Yes, WBRO needs to get this straightened out now.

Anyway, I have dealt with FCC filings for 25 years. I'd bet I could
volunteer to fix this very easily. I will not go round and round on
this gossip board with you guys any longer. But, I am willing to help
these guys with the FCC.
 
I do thank you guys for bringing this to my attention. WBRO is a community
station that serves a rural area of our state. This matter needs cleaned up.

Finally, I was a radio licensee who did not have money for lawyers. I had a
choice of a license or an attorney bill. If only guys who could pay for lawyers
could have a license, there never ever would have been a WKLU in Indianapolis.

And now EMF/K-Love is happy to have a license they could buy. (BTW: I believe the new owners can, and do, pay their lawyers.)

BTW: In WBAA's case, they filed the paperwork in CDBS but (per information filed with the FCC) "inadvertently neglected to respond to one item on the form." That being an item having to do with applications being submitted without a filing fee. The renewal application remained in "READY" status until the FCC brought the failure to renew to the licensee's attention. (See here.) If you don't check that box correctly the filing stays in READY until the required fees are received. It was Purdue's error.

WBAA amended it's application to then current information and the renewal was granted January 27, 2007.

WBRO's history shows no 2004 filing only an accepted renewal application and an STA that got them through December of 2006.

I expect WBRO will receive it's renewed license very soon. This is
what the FCC indicated in emails yesterday.

The WBRO case may be like WBAA case except that the man who filed for WBRO
in 2004 died soon after. He died believing he had done it right. A copy oh the 2004
application was in the public file. Perhaps, it was the fee filer that tripped him up too. We'll never know.

In 2006, I learned from the FCC that 2 Indiana radio stations had their licenses
canceled for failure to file license renewals. I contacted WBAA and WBRO. I
informed them this needed to be done right away to save the stations. I offered
to help. WBAA used an attorney. I helped WBRO with their filings after speaking
with FCC attorneys who were very kind.

A few days ago, my wife's mother died. In between making arrangements,
I find this thread about WBRO. I was angry at myself. I had not finished
the job. WBRO needed more help. So, I contacted FCC officials and brought
the case of WBRO to their attention. They promise to act on it soon.

As for WBAA. I rate them as one of our Indiana's best stations. I found their
FM channel for them back in the 1980's and helped get it allotted .

The FCC rarely gets press. Purdue put out a press release in 2006 that
spoke of an FCC mistake in this matter. Here's the FCC version received yesterday.

"Mr. Quinn:
Regarding WBAA(AM) and WBAA-FM, I realize that the University’s press releases attempted to paint the picture of a mistake by the FCC. That was unfortunate on the University’s part, because it was a mistake on the part of the University – neglecting to check the box on the license renewal form indicating the no fee was required because the stations were noncommercial educational facilities run by a university – that caused the electronically filed applications to sit in limbo awaiting notification of a fee such that they could be forwarded to the Staff for processing. We bent over backward to help the University out of the jam it put itself in, and it rewarded us by crowing about how the FCC made a mistake and recanted our inadvertent error. Fine PR for the University, perhaps, but not an accurate characterization. No matter. Water under the bridge. Purdue’s stations are good to go until August 1, 2012"

So, Justalurker you were correct. Guess I can't believe everything I get in the newspaper!

I volunteer to help the little guys get licenses from the FCC.

Sorry for your loss and any annoyance my posts may have caused at a bad time.

Purdue's article, which clearly states "On July 25 the FCC posted a notice on its Web site stating that the commission had "inadvertently" canceled the licenses." should be an embarassment to the university. I went back through the FCC's website and found no such notice ... and found the letter from the FCC linked in my post above giving the true story. As the FCC says, water under the bridge now (a newspaper article is not a false filing so there would be no fineable action but it is still a not so nice way to repay courtesy).

Although I do wonder why WBRO's application was "ACCEPTED FOR FILING" 06/16/2006 with no further action. But it is still something that shouldn't be impossible to fix. (Hopefully no neighbors moved in on the channel - that would be annoying for all involved.)

BTW: I understand (from another source) that WBRO has had some problem with their transmitter. That was my primary thought when I asked the question ... are they on the air ... not to get deep into their licensing problems. (Although fixing the license is a good thing.)
 
I will vouch that the gentleman who basically helped get the station on the air as a community radio station did die, and I'd say it was an honest mistake. I listen to the station from time to time, and the djs are volunteers and members of the community providing a local service.
