Neither Depetro, nor anyone here is justifying rape, murder or anything of the sort. That's just a straw-man that you are using to justify your argument. Ridiculous and inaccurate.
The girl used bad judgement, which made her more vulnerable to a predator. It's as simple as that. A poor decision on her part lead to (but did not cause) a tragedy. Yes, she has a right to be on the street alone at 4 am - but this is the REAL WORLD and there are bad people in it. When you make such a bad decision, it can have horrendous results.
THAT is the argument that Depetro put forth and he has a right to that opinion. Would you like your girlfriend, wife or daughter to be running around the Bowery, drunk and alone at 4 am? I'd bet not - because you would be worried sick about the risk involved. And, that's the point.
Hey, I don't care for Depetro. I think that he has no pipes, his accent is awful and his topic selection is frequently amateurish. But not only did he do nothing wrong here, he probably cemented himself as a large-market talker with his various appearances on TV in the past week.
Most importantly, it's (still) a free country and he has a right to his opinion!
