Jury Slams File Sharer

A Minnesota jury hit a single mom with a verdict for $222,000 in favor of six record labels because she shared 24 recordings on Kazaa. The jury awarded the labels $9250 per song. In fact, it appears that she made 1702 recordings available.

How did they come up with $9250 per song. Did she profit from sharing? And what about the people that downloaded the music she put on Kazaa, aren't they liable also?

I can understand artists wanting to make a buck from their recordings,, thats right, you work you get paid. But you can't tell me that this woman put that much of a hurt on the industry. From what I see in entertainment news, these artists whose music she shared aren't hurting at all. Its the industry thats hurting and I still think they are picking on the little guy because its easier than fixing their broken industry. More and more bands are producing their own music, and distributing it themselves on line because of the greed and bad rep of the music business. Do they really think they are going to stop file sharing through court cases? The technology has outpaced their ability to police it.

Any other thoughts? I'd like to hear a music industry perspective on $9250 per song.
 
i think everbody should avoid buying any of the big media music and downloading them, and then buy the bands
cd's that they selling themselves. hopefully this will bankrupt the music industry all together.

Yeah, I'm just waiting for U2 to come to my town so I can buy a CD that they're selling. Oh, wait, it's still a CD produced by a major record company, and they still get their cut - along with the concert merchandiser who tacked on an extra $10 because it's a "souvenir".

Of course, we could all stop buying music from anybody except a local band that doesn't have a record deal. Now THERE'S a collection I want on my MP3 player.

What the heck is wrong with compensating the people who produce music instead of stealing their work?
 
i meant to say from the band's website's. where they will hopefully get 90 of the money and the record companies get maybe 5 percent. the records companies can go after the radio stations and scramble the songs from illegal downloads, to descramble the albums, the downloader has pay to descramble the albums or songs from a downloading system. hopefully i explained it better. thanks.

Cap, if the band has a record deal, it doesn't matter where you get the album. The band - and the record company - still get the same split.

If the band is unsigned, they get everything - minus the production costs, advertising costs, distribution costs, mastering costs, etc.
