Kelly Stevens is back

Kelly Stevens returned to B98.5 this morning after his stint in rehab for his last month on-air with the station.

I am glad to hear that he is doing well on the alcohol front. However, I hope he has luck in the job market.
 
Welcome back Kelly. Congratulations for making the commitment to sobriety. And sincere kudos to both Alpha and Kel for their professional handling of the show under these conditions. I suppose I will also congratulate Cox for allowing them to stay on through the transition.
 
poor guy, should have waited until June 30th to go in rehab- can't get fired while actively pursuing chemical dependency treatment.

Perhaps someone could take legal action if they are fired BECAUSE they went into rehab, but even that would be difficult to prove and win. In this case it was announced long before his rehab stint that he would be replaced on July 1.

You can pretty much fire anyone any time you want.
 
Especially since they are under contract. As long as they fulfill the terms of the contract how the timing of firing them matter.
 
i was just joking, but getting fired while actively seeking treatment for chemical dependency is a violation of the Americans with Disabilities Act. Nothing to "prove", its law- look it up.

OK - I did - just because you asked.

From Title I of the ADA
A covered entity-
(1) may prohibit the illegal use of drugs and the use of alcohol at
the workplace by all employees;
(2) may require that employees shall not be under the influence of
alcohol or be engaging in the illegal use of drugs at the workplace;
(3) may require that employees behave in conformance with the
requirements established under the Drug­Free Workplace Act of 1988
(41 U.S.C. 701 et seq.);
(4) may hold an employee who engages in the illegal use of drugs or
who is an alcoholic to the same qualification standards for employment or
job performance and behavior that such entity holds other employees, even
if any unsatisfactory performance or behavior is related to the drug use
or alcoholism of such employee

And when something is "law" - and you feel it has been violated by your employer, for example - you must PROVE in court that the law was violated. In this case, you would have to PROVE that you were fired solely BECAUSE of your alcoholism. The language of the ADA above shows that "being in rehab" does not offer some sort of magical exemption. It also clearly states that even if the person is a known and treated alcoholic, if they fail to perform their job functions because of it - they can legally be fired.
 
H wasn't fired. He contract wasn't renewed. They are not required to give him a new contract. If they were they could offer $20,000 I guess.
 
can you read what you wrote? that has absolutely nothing to do with what i wrote about. I didn't say people can get juiced up all they want and suck at their job, but if they are doing their job competently and actively seeking help for an addiction, they can't be fired for that reason.

I understand completely you keep speaking about a situation that does not apply to Kelly. He is a contracted employee and they appear to be fulfiiling the terms of his contract so why do you want to quote labor laws when they don't appear to be violating any of them.

Actually, that's NOT what you said. You said he could NOT be fired BECAUSE he was in rehab. There was nothing in your posts about "doing their job competently."

If you left radio you would not be posting here. Once in radio, always in radio. Remember hearing those needles over modulating on the board? :) heaven.
