KLBJ's Jeff Ward Hit With DWI Charge, Will Appeal

"I was not intoxicated," says the afternoon drive host on KLBJ (590 AM), adding, "I am confident the charge of driving while intoxicated will be dismissed."

Ward was pulled over for driving over the speed limit on Thursday night. Incidentally, he didn't do his show on Thursday afternoon, due to a previously scheduled vacation day.
 
Oh gawd.

I sincerely hope that 1) he wasn't DWI and 2) beats this thing fast. He's the only decent thing left on that station weekdays.
 
Interestingly the radio-info home page lists this as the second most popular story. It sure doesn't have this board buzzing.

The charges were dropped because APD is currently on a tear, arresting anyone who 1) admits to having had even ONE beer during the course of an evening and 2) refuses a breath test. If you'd seen the tape, you'd know the charges were dropped because he was stone cold sober and passed every bloody test.

Eventually, Chief Art A.'s cops are going to get nailed by one of these high-profile arrests that blows up in their face. It's time APD stopped bending over for MADD and started enforcing the law FAIRLY again.

No, I haven't been stopped personally. But Ward, and a lot of other people are now on the hook for hundreds, if not thousands of dollars in legal fees just to get their license back due to trigger-happy Austin cops who are under orders to arrest anyone who admits to a drink and refuses to self-incriminate.

lets look at 2 big facts

1. He has the police chief on his show frequently. If you dont think there is a buddy system involved, you are insane

2. Jeff Ward didnt blow. Ive been pulled over, and I hadnt been drinking, so I was happy to blow into the breathalyzer. He refused it. Why?

This is a case of him getting off because of his position.
 
Street wisdom has always held that you should never admit a single drink to a cop or blow if you've had even a single drink, as nobody really knows their metabolism, breathalyzer technology is sketchy, and your chances of beating the rap are better if all the prosecution has on you is camera images and field tests. It's better to spend a night in jail than to have your whole life upended by a DWI conviction. Hence the "no refusal" business we've seen lately, which I think will eventually be challenged as unconstitutional.

I have no doubt that friends in high places are valuable, but this does seem on the surface like overzealous police work.

I would never defend drunk driving, but if it's such a heinous crime deserving of life-ruining penalties, why do bars still have parking lots?

I've seen the transcript of the phone call. Acevedo said one sentence....."I told you if you were stopped to take the breath test. [click]"

And yes, the so-called breath test is sketchy at best.

If you think this is "getting off", just check out his bills for this travesty.

After looking at the facts of the case, I actually have no doubt that Jeff was not intoxicated and I think this was yet another case of the Austin police arresting anybody who as had even one drink (a reminder to all...its not illegal to drink and drive. It's illegal to drive while intoxicated. Two different things).

What really stinks about this case is the fact that Jeff was treated differently because he is "high profile" (the Chief's words). I am close to somebody who was charged with DWI and they had to appear in court 3 times before the prosecuter even had the evidence to provide to her defense attorney and then she couldn't take time to go over it, she had to decide her plea right then. The evidence against Jeff was reviewed and the case was dismissed within 36 hours because the chief got involved in this "high profile case".

I don't blame Jeff. I blame the chief.
 
It appears I may have to change my position on this one.....

What we apparently have here is an APD that does indeed arrest anybody and everybody who admits to having one drink during an evening. BUT if you're a "high profile" person, your "case" gets fast-tracked.

Wow. How wonderful.

I've been predicting for some time (in other places) that the "arrest first and ask questions later" DUI policy from Acevedo is going to get him into trouble. The Jeff Ward arrest may just be the one that does it, as this proves that not all Austin residents are equal before the law.
