This is in relation to document 6166 of August 21, 2000, legally notified on September 27, 2000, by which several technical, legal and administrative documentation was requested in order to continue the procedures to obtain a permit for the installation and operation of the television station mentioned in the subject, allowing for that a term of 240 working days, starting the day after receiving the referred document.
About this particular subject, we here inform that once the records of the mentioned station were reviewed and entered in the archives of this Commission, it was noticed that you haven’t yet presented the documentation requested in the document 6166 of August 21, 2000, which also stated that by failure in time and form, according to article 11, section III of the Federal Law of Administrative Procedures, the authorization 591 of January 22, 1991 will be cancelled by law. Since this documentation hasn’t been received by the due term of 240 working days, nor a request of an extension according to article 31 of the Federal Law of Administrative Procedures, applicable by extension, we have arrived to this situation.
Added to the previous matter, in inspection visits done on July 13, 1999, and October 1, 2002, it was declared in Acts 021/99 and 025/2002-TV, that “The station is not operating because the broadcasting equipment was damaged and the original provider is not operating any more in order to provide the damaged parts; they are now looking for a company able to provide service but due to the equipment brand, it is a difficult task”, from which follows that television channel 13, XHEW-TV in Matamoros, Tamaulipas, is no longer in operation.
Considering the previous, based in articles 1, 2, 11, section III and 13 of the Federal Law of Administrative Procedures applicable in this matter, and using the powers conferred by articles 3, section XV, 9-A, sections XVI and XVII of the Federal Law of Telecommunications; Fourth Provision of First article of decree that reforms, adds and abolishes several regulations of the Federal Law of Telecommunications and the Federal Law of Radio and Television, published in the Federation Official Journal on April 11, 2006; 1st, 2nd, 3 rd, 7 th -A, 8th and 9 th section V of the Federal Law of Radio and Television; and 1st, 8th and 9th section XVIII of the Internal Rules of the Federal Commission of Telecommunications, and since the station XHEW-TV channel 13 of Matamoros, Tamaulipas is no longer in operation, we declare the termination by law of authorization 591 of January 22, 1991, according to article 11, section III of the Federal Law of Administrative Procedures.
Therefore, effective with the legal notification of the present administrative resolution, the equipment that could be used to broadcast should be dismantled and you should refrain from operating the station in question, notifying that, otherwise, this Commission will proceed according to article 104 Bis of the Federal Law of Radio and Television, that states: “Whoever operates or uses broadcasting stations without permit from the Federal Executive, notwithstanding fines according to article 103, will loose to the benefit of the Nation all properties, movable and real state, dedicated to the operation of the station in question.”
