KSFV-LP 87.7FM

KSFV-LP (a TV station) broadcasting at 87.7 FM has turned their power up WWAYYY too high! It has happened within thelast few days. I noticed because I use an FM transmitter (for my iPod) and usually, 87.9 is super-easy to grab.

Well now 87.7 is bleeding all over the place.

Are they legally even allowed to broadcast at 87.7?

Interesting question there. TV Channel 6 occupies the 82-88 MHz range, the latter half of which is the lower end of the FM radio band. To be exact, TV Channel 6 is 87.75 MHz. So in any market that has a Channel 6, you'll hear its audio if you tune an FM radio to 87.7 MHz, if it goes that low (a few FM radios only go down to 87.9). That means in San Diego, CA/Tijuana, BN, you'll hear XETV, a Fox affiliate. If you're in Philadelphia, PA, you'll hear WPVI, an ABC affiliate.

Is this the same group that has been advertising on billboards around town as Guadalupe 87.7? I can't see how the FCC can allow this since the agency very clearly states that FM radio is to be broadcast only on channels 88.1 through 107.9.

To advertise themselves as an FM station (instead of a TV station) outside of the authorized band seems to be really stretching FCC regulations.

They have a First Amendment right to callthemselves what they want.

They violate no FCC regulation.

But, yes, they stretch the law. And in Feb. 2009 they will be silenced.
 
LPTV station in Alaska's did this for years. Not sure what they ran for video.

87.9 is a legal licensed FM frequency. But...
Sec. 73.501(a) "The frequency 87.9 MHz, Channel 200, is available only for use of existing Class D stations required to change frequency. It is available only on a noninterference basis with respect to TV Channel 6 stations and adjacent channel noncommercial educational FM stations. It is not available at all within 402 kilometers (250 miles) of Canada and 320 kilometers (199 miles) of Mexico. The specific standards governing its use are contained in Sec. 73.512."

Technically, your iPod FM transmitter is illegal too! Can't be FCC approved if it's outside 88-108 (Part 15-239(a)). Whole lot of them out there imported & sold illegally. I wouldn't expect a knock on the door :)

Yes, and if I remember right, those guys in Alaska got spanked by the FCC for doing that. I have no problem with this group calling themselves 'Guadalupe TV-6 or channel 6' because that is what they are instead of passing themselves off as an FM station which they clearly are not.

And if they truly were an FM station they would be short-spaced with KKJZ at 88.1.

I just googled the owners of this station--they were fined in 2004 for violations involving their STL. And three weeks ago got cited for the following:

By the Chief, Enforcement Bureau:

1. In this Order, we adopt the attached Consent Decree entered into
between the Enforcement Bureau ("Bureau") and Venture Technologies
Group, LLC ("VTG"). The Consent Decree terminates an investigation by
the Bureau concerning (1) VTG's possible false certifications and
violations of the requirements of Sections 1.65 of the Commission's
rules in connection with its applications for licenses to cover the
construction permits for the above-captioned deleted low power
television stations, and (2) possible violations of Section 74.763(b)
of the Commission's rules in connection with the operation of those
stations.

2. The Bureau and VTG have negotiated the terms of the Consent Decree
that resolves this matter. A copy of the Consent Decree is attached
hereto and incorporated by reference.

3. Based upon the record before us, and in the absence of material new
evidence relating to this matter, we conclude that there are no
substantial and material questions of fact as to whether VTG possesses
the basic qualifications, including those related to character, to
hold or obtain any Commission license or authorization.

4. After reviewing the terms of the Consent Decree, we find that the
public interest will be served by adopting the Consent Decree and
terminating the investigation.

5. Accordingly, IT IS ORDERED that, pursuant to Section 4(i) of the
Communications Act of 1934, as amended, and the authority delegated by
Sections 0.111 and 0.311 of the Commission's rules, the attached
Consent Decree IS ADOPTED.

6. IT IS FURTHER ORDERED that the complaint received by, or in the
possession of, the Bureau on or around May 30, 2006, alleging false
certifications in VTG's applications for licenses to cover the
construction permits for the above-captioned deleted low power
television stations and violations of the Commission's rules requiring
VTG to notify the Commission that the stations had discontinued
operations and to request special temporary authority to operate at
variance from the stations' licenses IS DISMISSED.

7. IT IS FURTHER ORDERED that the above-captioned investigation IS
TERMINATED.

8. IT IS FURTHER ORDERED that copies of this Order shall be sent by
regular first class mail and by certified mail, return receipt
requested, to Venture Technologies Group, LLC, 5670 Wilshire
Boulevard, Suite 1300, Los Angeles, California 90036 and to its
counsel, Richard J. Bodorff, Esquire and Gregory L. Masters, Esquire,
Wiley Rein, 1776 K Street, N.W., Washington, D.C. 20006.
