Silent Since April 5, 2012 Notification of License Expiration And Deletion of Call Letters
Our records indicate that FM Station KSLK, Visalia, California, has been silent since April 5, 2012.' As you are probably aware, Section 312(g) of the Communications Act, 47 U.S.C. Section 3 12(g), provides that "if a broadcasting station fails to transmit broadcast signals for any consecutive 12-month period, then the station license granted for the operation of that broadcast station expires at the end of that period, notwithstanding any provision, term, or condition of the license to the contrary."2
Although a Notification of Operation filed on July 26, 2013, indicated that the station resumed operation on July 25, 2013, with reduced power from a temporary antenna, there is no record that the licensee either sought or received authority to operate at variance with its licensed facilities. Crediting an unauthorized transmission as sufficient to prevent cancellation under Section 312(g) would be inconsistent with the purpose of the act, which is meant to encourage legal transmission of broadcast signals.3 Consequently, we find that KSLK(FM)'s's license has expired as a matter of law.
