(Latino 96.3) SBS/Emmis Lawsuit Settled

Inside Radio Morning Edition 7/29/05:

Remember that big fight in L.A. between Emmis and Spanish Broadcasting System over a format change and a tower?
It's been settled. Emmis says it's settled its suit against SBS – and that SBS has already moved the antenna for KXOL-FM (96.3) off the Emmis tower at Flint Peak. Inside Radio had expected SBS to move to a new facility at Verdugo Peak – and that's apparently happened. Bottom line – Emmis drops the suit, SBS withdraws its letter of complaint to the FCC, and that's probably all we'll know about the settlement for now.

I'm sure SBS had to pay a cash settlement to get this to go away. That won't be "nothing".

My guess is not likely near the $25 million Emmis was seeking - but who knows.

... with a much poorer signal for covering LA's HDHA areas.

The station appeared to be off the air yesterday afternoon....at least in Rancho Cucamonga it was all static rather than some static.

How sure?
Maybe Emmis felt their case was weak and agreed if SBS would just
move they would drop it. We want know unless the terms are disclosed. Will we?
Besides,SBS moved to a poorer signal,isn't that a reward to Emmis?

It's not likely that Verdugo is temporary. It is home to KROQ, and the second best non-Wilson site after Flint Peak. KXOL can not go to Wilson, so probably Verdugo is its permanent home.

SBS has filed both a STA and a license to cover app with the FCC in the past two weeks. Barring any technical issues (of which I don't believe there are any), this should be permanent within 60 days or so.

Still, it is obvious that SBS had to take a hit in coverage to settle the dispute with Emmis, so I don't think they won the battle by moving.

That might benefit Wild 96.1?? It seemed odd that they would assign a frequency receivable in most of the IE on something adjacent to a LA station.

However, the interesting thing is, even before, when they shared the site with Power, there signal was considerably weaker than the other Mt. Wilson FM's. 96.3 always came in poorly in the IE; and in some parts of LA and OC, you would get static and interference on 96.3 while the other stations came in clear...that's probably why they assigned 96.1 to the IE.

96.1 is really low power by comparison, and licensed to San jacinto. KXOL is a restricted class B in LA, and they don't overlap.

that is because they were not on Mt. Wilson. They were on Flint Peak at the KPWR backup site.

By license, that is absolutely normal.

Flint Peak is not Mt wilson. Lower OC, some parts of the SG Valley had really bad signals.
