Lawsuit Alleges Fox News Fabricated Quotes in Seth Rich Story

A private investigator who was put at the center of a controversial report on the death of a murdered Democratic National Committee operative is alleging he was placed there against his will by employees of Fox News Channel.

Rod Wheeler isn’t the most famous gumshoe, but his name became associated earlier this year with a now-retracted online report from Fox News Channel that used comments from Wheeler alleging Seth Rich, a DNC employee who was killed in Washington, D.C. last July, was linked to a leak of DNC emails by Wikileaks. Wheeler, who had made an appearance on Fox affiilate WTTG about the situation, subsequently told CNN he had no evidence to support the claims. Fox News host Sean Hannity, who had been discussing the Seth Rich theories on his primetime Fox News program, said in May that he would “cease” talking about the case out of respect for the victim’s family, though he would continue to investigate the matter.


Now, a complaint filed Tuesday by Wheeler in United States District Court in the Southern District of New York threatens to spark new conversation.

In the complaint, Wheeler alleges “Fox News was working with the Trump administration to disseminate fake news in order to distract the public from Russia’s alleged attempts to influence our Country’s presidential election,” according to his attorney, Douglas Wigdor. Wigdor serves as attorney in several current cases alleging harassment or discrimination by Fox News Channel executives.

The lawsuit alleges Ed Butowsky and Malia Zimmerman, a Fox News contributor and journalist, respectively, “fabricated two quotations and attributed them to Mr. Wheeler,” and included them in the now retracted article.

“Mr. Wheeler — who was the only named source quoted in the article — did not make these statements,” the lawsuit alleges. Instead, the suit says, “Zimmerman, Butowsky and Fox had created fake news to advance President Trump’s agenda.” Wheeler “was subsequently forced to correct the false record, and, as a result, lost all credibility in the eyes of the public.”

The original Fox News posting on the matter lent momentum to right-wing outlets including Breitbart and The Drudge Report, which had suggested with items and links, but little credible evidence, that Rich could have been killed for the leak of DNC emails during last year’s presidential campaign, an act that has largely been attributed to Russian interference.

“The accusation that FoxNews.com published Malia Zimmerman’s story to help detract from coverage of the Russia collusion issue is completely erroneous,” said Jay Wallace, president of news at Fox News Channel, in a statement. “The retraction of this story is still being investigated internally and we have no evidence that Rod Wheeler was misquoted by Zimmerman. Additionally, Fox News vehemently denies the race discrimination claims in the lawsuit — the dispute between Zimmerman and Rod Wheeler has nothing to do with race.”


Well its been basically normal to hear Fox News in Lawsuits for the past year but this time its not Roger Ailes or Bill O'Reilly this time its on Rod Wheeler and the Seth Rich fiasco. Also Fox News was in the middle of reforming itself after the removal of Ailes and O'Reilly.

It has been more than two months since Fox News retracted its story about the death of Democratic National Committee staffer Seth Rich, and the network still claims to be investigating what happened, leaving its employees perplexed and wondering why there has been no explanation and no action taken to put the issue to rest.

"People are talking about it," a Fox News employee told CNN. "Frankly, there's confusion over it."

More than two months ago, on May 23, FoxNews.com deleted a story that suggested Rich had been in contact with Wikileaks before his death. The story rested on quotes from Rod Wheeler, a Fox News contributor and former homicide detective hired to investigate the unsolved murder on behalf of the Rich family. He was quoted in that article saying there was evidence showing Rich had been in contact with Wikileaks.

The story was immediately seized on by President Trump's media allies, who treated it as an explosive scoop and used it to cast doubt on the US intelligence community's determination that Russia-backed hackers stole the internal DNC emails published by Wikileaks. For a little while, the story was everywhere in the pro-Trump media universe -- including two of Fox News' biggest shows, "Fox & Friends" and "Hannity."

"The retraction of this story is still being investigated internally and we have no evidence that Rod Wheeler was misquoted by Zimmerman," Wallace said in his Tuesday statement.

It's not clear why the investigation has taken so long. Presumably, Fox News has access to all the individuals involved. Wheeler is a Fox News contributor and Zimmerman a reporter. Asked about the current status of the internal probe, a Fox News spokesperson told CNN on Wednesday that the network had "retained outside counsel on the matter" and that "given that this is pending litigation, there will be no further comment."

But even as a major article she wrote has been the subject of an internal investigation, Zimmerman has continued to write stories for FoxNews.com. She published five stories in June, four in July, and one on Tuesday, the day the lawsuit accusing her of fabricating quotes was filed. Moreover, the site has apparently not shied away from promoting her work. Her July 18 story on Hillary Clinton's policy toward Russia, for instance, received top billing on the Fox News homepage.

According to half a dozen people spread throughout Fox News who spoke with CNN, all this has left employees at the network wondering what is going on with the investigation -- and why there has not been an announcement either of disciplinary action or a finding that there was no wrongdoing.

"People need to start getting canned over the [Seth Rich] thing," an employee told CNN. "What a mess."
 
CNN had a lengthy live interview with Ed Butowski on Monday night. He challenged the suit, said the quotes were correct, and directed viewers to a website where they could hear audio of the interview with Wheeler proving his case. Butowski said he is friends with Sean Spicer, met with him in the White House, told him the story, and that was it.

My view is that no story should be used based on only one source. Especially given the seriousness of the story. Zimmerman shouldn't be the scapegoat. Others in the news chain had to approve this story for it to have made it as far as it did.
 
I think it's pure greed Fox News took the story down and sorry to the Rich family although surprise they aren't suing Sean Hannity as well. This is a baseless lawsuit without facts or proof.
 
I'm not sure greed was the motive. I think Hannity was onto something but, at the request of the family, he backed off.
