Lotteries

Here is what I think...the FCC view of a lottery is clear...there are three elements that must exist for a lottery...PRIZE...Consideration ...and Chance.
Any two are OK, all three is unacceptable...In my opinion, stations are advertising lotteries everyday..maybe they think that if casino advertising is acceptable...so are lotteries. I am not an attorney...but I would not want to have an FCC inspector hear a spot advertising..." come in and buy anything and be eligible to WIN $1,000....all three elements are there!
If I am wrong, somebody please correct me...I reject this type spot all the time

I remember having my lottery-radar go off a few years ago, when a local morning show was doing a marathon for a charity. They were having a drawing for a prize (seems like it was a nice prize, I forget...), and you could enter if you contributed at least $100. I knew no one at THAT station had a clue what they were, in effect, doing; but there was the combination of had prize, consideration, and chance.

I wish there was some agreed-upon standard so that the biz could take a position on these things and establish some norm. These house giveaways are bound to attract regulatory interest. They just smell bad.
 
J Boyd nailed it with "prize" "consideration" and "chance". Period. It's just that simple. Only casino advertising and state lotteries are allowed. In my former life as a production driector, I saw countless attempts to skirt the issue. Fortunately, I had GM's that understood the consequences. The hardest part was dealing with rookie sales dogs who didn't get it. I'd just send 'em to the GM.
