LPTV question

Does anyone know if an LPTV can be sold to a cell company or other non broadcaster if it is in the proposed auction group of channels? I have a client with a Channel 43 who is certain he can do just that and I am not educated enough in LPTV (or TV in general) to answer.
 
Answer to this question will probably await the writing of final rules by the FCC (based on the recently passed law by Congress).
 
There are no changes to LPTV rules coming. The FCC's TV branch has a far better set of rules for LPTV than does the FM branch which had to deal with Congress getting involved. LPTV's can be commercial and may originate programs or they may act as translators, The FCC does not differentiate between them. LPTVs, except for class A, receive no protection from interference.

So, if your question is can they be sold for a profit, the answer is absolutely yes. Can you sell an application that's designated for auction? Probably not because of the anti-collusion rules. If the buyer is not one of the other auction applicants and intends to go to the auction, the FCC may allow it. Contact the FCC or an FCC attorney for a written opinion before proceeding.
 
Believe he's referring to the recent provision in the payroll tax extension bill that will allow UHF TV stations to allow their channel to be auctioned by the government to telcos in return for a share of sale amount
