The Maverick

IS it legal to use Vhf RPU freqs in 161 mhz range as STL freqs?
I have been hearing a unammed am station continously on 161 megs,
Considering there is a VHF yagi on the roof of their studio, I suspect they are using a RPu frq as a STL ,
Is this normal? or better yet, LEGAL???????
