Memphis Morning Show Mentioned on Sirius

Today I heard a guy call into the "Bubba The Love Sponge" show on Sirius 101 and mention Memphis radio station Rock 103 and The Wakeup Crew. The man said that they (The Wakeup Crew) used a BTLS bit just before 10:00 AM this morning and did not clarify that it was a BTLS bit. BTLS said they have warned other shows about using their "intellectual property" without permission. He also mentioned that he thought Clear Channel shows were the worst offenders at using their bits without permission and that they had sent C&D's to other shows for this type of thing.

Not saying “bit theft” didn’t happen, or never happens…of course it does, but I suspect those C & D’s are just bluff. Maybe Dead Elvis can help out here, but I would think they’d have a really hard time proving a bit was original and never used anywhere before unless it was a created character or something similar. And we all know Bubba never borrowed any bits, right?

I have sent C&Ds. Yeah, they are usually bluster. I have one issue now, though, that may require some action. But, I digress...

But, the larger issue is whether what BTLS called "intellectual property" is protected. I am betting not. Just 'cause someone lifts an idea, does not necessarily mean anything is actionable. Generally, people think IP law extends further than it does.

Don't forget about common law rights that incorporate "first in use" concepts.

The BS letters don't mean a thing unless they want to file an action. My company is defending one now and is in over 150K in legal costs....it is a simple matter.....only some resistance.

Think that bit is worth 150-200K?

I would lift a few more bits.

If Bubba was defending his "intellectual property," wouldn't there have to BE something "intellectual" involved? That word and Bubba don't come up in the same sentence all too often.
