How many more blatantly illegal things will this company do before they are finally investigated? Trust me, the day will come when Cumeless is held accountable for the way they treat their employees and the laws they break which they feel do not apply to them.

It is not illegal, per se, under FEDERAL law to fire someone for being fat. I suppose one could cobble an argument under the ADA, but that's a stretch. I am sure there is some caselaw on-point somewhere. Now, some states may have some state law on-point, but I doubt that Alabama is among them.

It's an interesting question, really. As medical insurance costs rise, employers will be faced with these issues, but, that's a bit too esoteric for this forum.

Now, pregnancy is another matter. Firing an employee for being pregnant violates Title VII of the Civil Rights Act, as well as the ADA, and various state statutes. It also exposes an employer to a whopper of a civil suit, and is frankly, a bit tacky. Surely, Cumulus, or any other employer knows better. There are often multiple sides to such stories.
