MONDAY MAY 19, 2008-READ THE SECOND PAGE OF "THE METRO"

Hello, thank you for your time. Ok, a lot of people here always put down these people at Touch 106.1, saying they are "criminals" just because they run a (pirate) station.

Read the "Metro" the second page of todays "Metro" Read it when you have time, and now, think and think hard before you all call these people "criminals"

They are just (real) people out there (trying) to do (good) things for the community and listeners who lost their true Urban AC station W I L D 1090am and W I L D 9 7 7, and Star 93.7. Touch 106.1 is just trying to do good things for those listeners and the community.

If you don't know nothing about Touch 106.1, or not know their purpose, please, don't put these people down. They just trying to do good things for us. They play some Classic Soul that I havn't heard a LONNNNNNGGGGGGG time, that Star 93.7 (never played) and that W I L D have not played since ??? 1983
Please, don't put those people down.

Read the newspaper today.

I also suggest that you go to Dorchester/Roxbury area and on Thursdays, get the Newspaper called "The Banner" It is a FREEE Newspaper. In there, you will see community events that Touch 106.1 is a part of.

Then you think again before saying the bad things.

Thank you very much for your time

Whitey Bulger: Helluva guy. Yeah, he killed some people but he did nice things too. I suggest we all
write the FCC and tell them Touch 106.1 deserves a legit license. Of course, to do this we'll have to
find a legit station, prove they've broken rules, and get THEIR license pulled to make room for,
let's say, the new WTCH-FM 106.7 (sorry, "Magic", but we're pulling your license!)

Besides, the guy that stole my car, I'm sure he needed it for a real good reason. I forgive him.

Better yet, someone should start a classic country station at 105.9, a few blocks away from
where Touch is broadcasting from. We really need a station like that in town and so what if they
break FCC regulations to get on the air. People who can't afford satellite radio NEED to hear
Hank Snow. And the new HICK-105-NINE is just the station for them!

Well, I'm off to see my doctor. He doesn't have a license and never went to med school, but that
doesn't bother me. He's a good guy and I'll take these special illegal pills he gave me, they'll make
me feel better. What a guy!

So, let's see if we have this straight: An article in the Metro magically transforms criminals into upright citizens. A newspaper article negates Section 301 of the Communications Act, which the operators of Touch-FM are violating. They get a pass because they're "nice" people and are involved in the community.

I definitely want some of what you're smoking.

I'm sure there are some people involved with Touch that do not know that they are breaking the law. I'm sure they are all nice people.

However, the man behind it is well aware he is breaking the law and doesn't seem to care. He is a criminal.

Tony Soprano did some nice things....Whitey Bulger, Raymond Patriarcha, Gerry Anguilo I'm sure did a lot of nice things for the Italian community.

Doing a few good deeds with the proceeds from criminal activity is not a virtue.

ILLEGAL!

http://www.fcc.gov/eb/tpsd/ulo.html

>>Section 301 of the Communications Act prohibits the ``use or operat[ion of] any apparatus for the transmission of energy or communications or signals by radio'' without a license issued by the Federal Communications Commission...The Commission takes enforcement of Section 301 seriously. Parties found operating radio stations without FCC authorization will be subject to a variety of enforcement actions including seizure of equipment, imposition of monetary forfeitures, ineligibility to hold any FCC license, and criminal penalties.

http://www.fcc.gov/eb/Orders/2008/DA-08-1073A1.html

>>ACCORDINGLY, IT IS ORDERED that, pursuant to Section 503(b) of the
Communications Act of 1934, as amended ("Act"), and Sections 0.111,
0.311 and 1.80(f)(4) of the Commission's Rules, Charles Clemons IS
LIABLE FOR A MONETARY FORFEITURE in the amount of $17,000 for
willfully and repeatedly violating Section 301 of the Act.

Let's all throw a big "rent party"-type fundraiser for Charles Clemons so he can pay the $17k fine.
Then he'll go back on air and get fined again and we'll do it again. Nice man, we should help him! :)

so, Lauro - feelin' the love yet?

yep, seems to me that everyone here is on your side on this one.

i feel their pain - but then again - as a kid (circa 1970/71) i did what they did, only with a little bitty radshack mitter from a buddy's attic. and at staggered times so "they" couldn't really track us down. and with fake names (like Erie Lackawanna, Ferd Berferd and Finster Binstley). and it was on the AM band. but at least our parents knew where we were and what we were up to.

and we knew enough to not try to plead "our case" in the local, legit media. we were prepared to take our lumps if caught. although we might have omitted the whole significant dollar amount of a fine that could be levied when explaining to our parents about the "good clean fun" aspect.

to whom do i make out the fundraising check? i've got one ready to go, drawn from my Jack Sparrow account. ;)

>>Requests for full
payment under an installment plan should be sent to: Chief Financial
Officer

Hey! The FCC allows an installment plan! Just as if you were buying a $17,000 car on a loan (not sure
if they charge interest, though). Nice of them.

All I said is they did nice things for the community. I didn't metion nothing about Whitie Bulger or anything like that
I don' mean to start no war here

All I'm saying, besides being an Illigal station, they did nice things for the community

Someone suggested why not get all their sponcers together and go on a station such as 1600am, or 1360am and just have the sponcers pay.

I'm just acknowledge the good that they did. Look at that bright side

Well, you said to read the Metro article and think twice about calling them "criminals". Guess what...the article has been read...it's been thought about twice, maybe even three or four times...and you know what?? They are STILL criminals.

They should take a page from their own book, and "man up" --
pay the fine like an honorable man, and shut it down.
They are criminals - always have been. Period.

EVERY radio station inthe country sponsors events to get publicity and to try to gain listeners! How is this doing good for people? It is self serving. I feel it also hurts the cause because they are going to be associated with criminal activity! It doesnt help the cause, it doesnt help the people, it only helps touch! Boy some people are really gullible!

So when station finally does get shut down, are we gonna hear outrage? Also, they are broadcasting on 106.1, right? I remember another certain station that did that on the very same frequency 10 years ago and got shut down. Why, because their signal was interfering with a legitimate licensed WROR at 105.7.

I Love Pirate stations ! Touch-FM The Best Music Station in Boston .

I know how you feel about Touch 106.1. I admit I would feel the same way if Pulse 87.7 in New York was actually a pirate station instead of a TV station, and had the same format. But you don't have to say it a gazillion times.

This is great - whenever there's a thread on here hooting on such and such a program, or such and such a station, the radio people shout like a chorus - "just change the station if you don't like it!" So when a station appears that actually meets one of the needs expressed by the hooters, and is worth listening to, what do we hear? "Hey, what are you doing listening to that station? - Change it back!"

Sometimes an industry needs to hear what people want, even if there is a crime involved in those people getting what they want. Look at the record business, which railed and whined and boo-hooed about P2P, Napster, Morpheus, etc. Some said the industry was finished. Instead, the "crime" forced them to confront the groundswell and deal with it - and now they've happily adapted. Radio people ought to stop judging their listeners and start hearing what they say, even if they don't like the way they're saying it.

These folks could rent time or buy a a station. Instead they decided that the law doesn't apply to them and they just put one on the air. They have been served and they continue to operate. The fact that this is okay with you is what amazes us.
Unlike "EVERY" radio station they don't have to awnser to anyone? ASCAP, BMI, FCC, IRS nobody

Not only that but what if someone from the "community" got injured by coming into contact with thier transmitter or antenna, what recourse do they have? Do you think "Touch" has paid for the proper insurance if they are unwilling to pay for the proper licenses? What if one of thier "employees" got hurt at work? What if she or he is unable to work or god forbid dies because of the injuries they recieved while working for "Touch"? What is thier family supposed to do? I am sure that they don't have unemployment insurance, workers compensation insurance, or liability insurance because no Insurance company I know of will insure a business that does not have all of the required licenses. What happens to the families? Are they really helping the community if they are not even responsible enough to make sure that thier "employees" and the community are protected?

It amazes me how some people are so gullible in this world. "Touch FM" is clearly a business enterprise. I have listened and I have heard the advertising. They are also working very hard to get thier name and frequency out there. Almost every radio station does promotions that helps good causes like blood drives, toys for tots, USO drives, cancer walks, etc... do they do this only to help these causes? Maybe, but I think it's more likely that they look at it like this... "We can do something to help people, and also get some good press and get our station in the papers and on the news and get our frequency and call letter out there and hopefully add some listeners and increase our billing" To think that "Touch" is doing anything different than every other station is nieve at best.
