Okay, we've got he said she said. So start looking at the 'other' evidence:
Is he having IRS problems? if so doesn't that back up her story?

It would mean that her story contains some facts.

Has he threatened her before, told her she was going to kick her ass, whatever? If so, are there witnesses she can call who'd back it up? friends, family, etc who can tell how she has been worried before about his temper? if so, again, backs up her story.

Character witnesses would have to have direct exposure to his fits (off-air).

In all those 'best of' tapes, does CBS hold any that show Russ losing his temper and yelling at someone? Shows state of mind, shows he has a temper (which backs up her side of the story). And sure they can defend it with 'that's just a bit', but at some point, the prosecution can claim that with his show you never knwo what's real and what is a bit. Sure NOW they claim it's a bit, because they have to defend against it...But they don't tell their listeners these are bits, do they? They want the listeners to believe that he's really fighting with Henry or Spittle or JD or whoever. So if they don't tell the truth on-air, why should we believe thatthey're now telling the truth in court?

Because it is an entertainment talk show. It's not even a news show where they might be held to a standard of fair and balanced.

Subpoena the phone records- did he call when she said he did? Subpoena the accountant- has he been having IRS problems

That's not directly related to the case. I'm probably ticking you off a little by writing these lines, so I hope nobody ever holds that against me in court.

Why did you remain engaged to someone that you believe capable of not only injuring herself, but of fabricating a story that is this damaging to your career'?

Who said anything about pathological? Fabricating a story for a setup doesn't imply that a mental disorder exists. Also, he may have actually injured her, but he may not have been the aggressor. And, it's amazing what some people can do for money.

As I said somehwere else, if you took someone who's got a squeaky clean reputation (Chapman?) and accuse him of this, it'll be a lot harder to believe. But Russ? It's believable, you've got eyewitness testimony of his fiance (so not just some random chick looking for publicity or a payoff), and you've got some physical evidence that we know of (computer, pictures of her wounds) and possibly some that we don't know about (did she really tape it? do the cops have the tape?)...

If this was a setup, you bet she's banking on this being believable based on his on-air persona. And, she's not a random chick. She could have planned this all along. Or she could have wigged out when he broke off the engagement. It doesn't prove that he was the aggressor.

Let's see...........like someone at KLLI, KEGL or his other workplaces, perhaps? Former girlfriends, maybe? I'm willing to bet there are witnesses to off-air verbal explosions out there. Could be somebody will come forward regarding physical stuff now that the cover has come off. The Tarrant County DA is going to go through Mr. Martin's personal life with a fine toothed comb. He has the power of subpeona for recalcitrant witnesses - Wonder how Clo will do on the stand?

Too much media coverage for this to go the OJ way. The DA certainly doesn't want to hear "You're a fool!" from his constituents.

On the advice of her attorney, she's probably waiting to file a civil suit pending the outcome of the criminal action. If not guilty, she's gonna get some dough because, as other posters have mentioned, the burden of proof is less in a civil action. If he's found guilty, ka-ching!!!!

I was a huge Russ fan for years , I quit listening when Howard came on Sirius.
I would tune in from time to time when Howard was on vacation , Russ was still
talking about the band , trying to get JD to say the N word and picking on Gavin.
That was funny a few years ago , for a while I thought I was listening to best of
then I thought this is not funny . I have met Russ several times , and he was always
a nice guy . I wish him the best .

I believe you are right about the timing, but that only indicates that they were having problems and is not proof that he threatened her with a gun.

No, not necessarily. If I remember correctly, the suit is brought first, then discovery is done - we're not there yet. It is possible that if he is absolved, he will sue her for defamation of character or something similar. Lost advertisers, even in the short term, can show actual damages, whereas dropped charges give him only a tarnished name (as many on this board have already stated). Obviously, having the charges dropped would be good, but a successful countersuit would go much further to exonerate him.

He'll never sue.
He's a public figure. To win he's got to prove "actual malice". IOW, he'll have to prove that not only was she lying, but she knew she was lying when she made the report, etc.

If she was lying, and knew she was lying, she's got perjury, false police report, etc criminal charges she'll be messing with first.

Here is the thing that pisses me off the most about this. As a previous long-term regular Russ listener, I will admit to laughing at some of these gags, bits and comments. But I did so under the belief that Russ was absolutely squeaky clean and that he would not be dumb enough to be making jokes about abusing women while actually doing it, as that would be evidence the guy is a sociopath totally devoid of a conscious. So I always figured that it was okay to laugh a bit, because Russ was really a good guy who has never even thought to raise his hand to a woman in his life. Instead I have been completely scammed and I feel dirty and disappointed with myself for every even mildly chuckling at one of his abuse jokes.

I agree with you completely Marksman. This is exactly how I feel, like he made us a part of the abuse by making it something we could laugh at. However, I'm one of those that does think that life has become too PC and that we can't joke about anything without someone screaming that its wrong. I don't think that laughing at a ridiculous situation, even one that is at its base dispicable because it could possibly in some weird scenario turn out to be true, makes you a bad person. Russ presented the dash story in such a way that he was actually doing the girl a service by keeping her from jumping from the car. Guys, be honest, has a girl EVER tried to jump from a moving car because she didn't want to continue a verbal argument with you? Of course not! We'd have to be insane to do such a thing so the whole premise is ridiculous and therefore almost anything that comes from it can be laughed at. We feel guilty because unlike Russ, we can't really comprehend doing anything violent like that and to learn that we've been laughing at something that actually happened just sickens us. :'( This has been a bit rambling so I hope I make sense.

I do know several women who have tried to get out of moving cars. My mother has done it more than once. Its not rildiculous and it does happen.

In the news recently (6 months or so), there was a guy that was driving and jumped out of the vehicle during an arguement with the female passenger. She was able to bring the vehicle to a stop but he was run over and died.

It can and does happen.

Oh Yeah, I do remember the story about the guy who died that way. And I'm sorry to hear about your Mom, but it IS ridiculous to think that she or anyone else would do that. I just can't fathom how bad a verbal argument could be to put myself or other people at risk by jumping from a moving vehicle so I never took that particular Russ story as anything but make believe. Now if there was something physical going on in the car and it seemed that jumping would be the safer option then that would be different, but otherwise, its ridiculous. :

No nothing physical is required for a woman to want to get away from a man. In the cases I have seen, its always a verbal disagreement that causes it. The woman is usually frustrated and irate and just wants to get away from the guy and the situation. Now I'm sure you are picturing someone climbing out of a car at 70 mph. That's not always the case. It could be that the woman jumps out at a red light or when the car is moving slowly (like in a parking lot). Its not always quite as dramatic as it sounds. I have never done it myself but I've certainly thought about it a time or two. Actually what stopped me from doing this was Russ. I remebered his "dash" bits and decided I didn't want to be that cliche' nutty chick. LOL look at that!!! Russ actually saved me from doing something stupid.
