MOre trouble for WELE - Wilhite arrested again

Is it any wonder that when Doug sold WSSA the first thing the new ownership did to dis-associate themselves from Wilhite was to change the calls to WIGO. I wonder how much he got for that property. WELE is ruined. Wilhite needs to be OUT and the Calls need to be changes as well as the format. I'd go with WWML and flip to Music Of Your Life.

Wilhite cannot legally sell WELE under any conditions at this time until a certain FCC matter is cleared.

I just talked to a friend at the FCC, knows what is happening...

1. IF Wilhite is judged guilty, the FCC would have a group in The Media Bureau together to discuss the charges and see if it was 'in the public interest' for Wilhite to still own the license. The type of felony involved is given weight to their decision. So, no definitive answer as to whether he would lose the license or not. Again, he is now operating legally, so that is not in question, but the problem or problems of WHY the 2004 relicensing is still in ‘pending action’ must also addressed and cleared yea or nay against the station. Two headed monster, a conundrum wrapped up in an enigma, located between a rock and a hard place. He finds a buyer, but must get FCC approval for sale or transfer, but the ‘pending’ is in the way.

2. He could still sell the station now even with liens and whatever AS LONG AS no illegal action was or has been taken place DEALING WITH THE STATION ONLY... nothing in his personal life as the accusations and upcoming trial. A don’t forget he was totally exonerated from ANY criminal doings for the Travel Show thing by law enforcement. All that can happen now are small claim court actions, which have begun.
And it goes without saying the buyer would have to be aware of the books, liens, and the whatever.
Most importantly, if he finds a buyer the FCC MUST approve the sale and transfer.

You just said it yourself. The "Pending" in the license renewal is the major problem which has nothing to do with the current civil legal actions nor the personal felony charges against Wilhite. I had also pretty much said what you did regarding any FCC action the Commission may take should Wilhite be found guilty. The license "may" be revoked, not absolutely. The probelm remains that untill the license renewal situation has been decided, WELE's broadcast license cannot be transfered from Wings Communications, Inc. to any person or entity. The best he can do now is sell the station assets under an Asset Purchase Agreement and then LMA or TBA the broadcast license to the buyer with an option to transfer the license once the license renewal has been cleared with the Commission. Those are his options if he is planning to sell WELE.
