MORNING SHOW PRANKS, ARE THEY LEGAL

I saw a comment about pranks going too far on this board a while back, and my question is how do you get a caller to go along with a prank...before letting them in on the secret. My GM says, we can't do them unless we can get permission, but DAMN it spoils the bit. What do you do? We've just done the prank and then ask for permission to air it. Haven't run into a big problem yet...but there is always a first time. Am I playing with fire? But, it makes for great radio.
 
That is a good question. The good rule of thumb, if you don't have permission prior to the start of the call you have violated an FCC rule. You can't record anyone with our their permission first, and you must gain permission to play it on the air. So, technically you must have permission twice. If the person complains not only can this situation become litigious but they can also file a complaint to the FCC and the licensee be fined, and suied by the party recorded without permission. Very touchy subject, make sure you have the permission.
 
WOW, you must have bugged my Gm's office. We had this very topic come up today. We are being warned not to do pranks, he told us no pranks on air ever. I'm afraid this is going to make for some very BORING radio on our morning show. He doesn't want to risk a suit.
 
You better be careful with Pranks, the FCC doesn't like them, and the courts aren't too friendly either. Be super careful make sure all your bases are covered for your careers sake. It makes for boring radio, I guess. But, watch you. Be warned.
