Music and "The Man"

OK, I'm helping out some kids who want to do a podcast and I hope somebody out there has some info that will help.

I'm trying to warn these kids that if they play any copywritten music and anybody from the RIAA or record labels finds out that they are potentially on the hook for big problems from lawsuits to big fines, etc. Can anybody cite a news article where a podcaster got busted for such an act? I want to be able to show these kids this is very real and they can get very busted.

Thanks for the link. I was really hoping to put the fear of God into them about being busted, though. There's always news about people getting nailed for file sharing but I haven't been able to find any similar situations for those who use commercial music in podcasts. I tried to tell the kids to use one of the PodSafe music outlets but their retort was the music was "lame" - I told them how lame will it be if you can't go to college if mommy and daddy are footing the bill for your illegal use of music. But you know kids!
 
I understand, but don’t crush their podcasting dreams unnecessarily. It sounds like they are some creative kids, so give 'em the facts and let 'em have at it.

Believe me, the last thing I want to do is kill it for them. They have asked me to be a mentor for them, but I need them to realize there are some very real circumstances to not playing by the rules. I hope to sit with them and show them there are decent music selections available that are Podcast-safe. They are very creative and I hope to have a production from them in the coming weeks.
 
This is why we have to stand up to the idiots at the RIAA and SoundExchange, They have screwed around good honest people who have a love of both broadcasting and music, all in the name of a buck...why is it other countries, esp. in the EU, have got it together in when it comes to music royalty and licensing for web broadcasting.
 
Apple really ought to step in and offer some kind of solution to this. What I suggest is this: Let podcasters upload podcasts containing properly identified "major label" music to iTunes for a new Podcast Store, and offer different payment options:

For non-com podcasts (only underwriting messages allowed, restricted to a maximum of 5 minutes total for any program 60 minutes or less, and 5 minutes per hour for longer programs):
1. Listeners can download any podcast they like for 99c per hour plus 50c for each additional half hour. The podcast creator receives perhaps 5c per 1st hour plus 2.5c for each additional half hour. The rest of the revenue is distributed as it is with song downloads, to the artists/labels/etc whose music was used. Podcasts downloaded in this manner would not be burnable to CD, but could be put on as many iPods as a listener has at her disposal.
2. Listeners could subscribe on a permanent basis to those podcasts that they want to hear on an ongoing basis. For example, if a full podcast of NPR "All Songs Considered" (where every song was played in its entirety, as heard on the streaming version of the show) would normally run either 99c or $1.49 per episode - listeners could subscribe for $7.99 to receive 10 episodes of the show - this could optionally auto renew, or expire, as a preference for each paid podcast. The revenue share would be similar percentage-wise as the first option.

For commercial podcasts, I would like to see others' suggestions. I'm not sure what would be fair.
