No Competes Illegal in NY-Why not in PA?

Does anyone think eliminating no-competes in PA is a good thing? I tend to feel that if an employer can offer a few incentives, then they can justify adding on a no-compete clause. But if they're just offering you a paycheck & nothing more, I don't feel they have any right to force a person to be harnessed to their job should they be offered a better position.
 
The New York local of AFTRA has been fighting non-competes and no-competes for decades. It was a hard battle and the new law remains subject to court tests and appeals. But it's a step in the right direction. Non-competes in a location like State College are as pernicious as they are anywhere else. If an employer can fire someone for no reason, then it should not have the right to restrict the former employee from making a living, unless, of course, the company is paying off a contract at full rate and full benefits. And maybe not then, either.
 
Non-Competes in markets like Altoona, Johnstown and State College only serve to discourage potentially good talent (on-air, sales, and management) from continuing on in radio as a profession. If you treat your employees well, pay them what they are worth, and give them an environment in which to excel and succeed, why would you worry about them leaving? If you treat them like crap, promise them what you will never deliver, give them a negative environment I'm sure you are probably a company that relies on non-competes. It may only be a matter of time before PA sees the same legislation as NY regarding non-competes. On the local level a former Forever sales employee challenged a non compete when she went to work for Barger, and won. A trend in the right direction I think.
