non compete law passes

From the bosses email:

SPECIAL ALERT SPECIAL ALERT SPECIAL ALERT

Soon after NYS Senator Joe Bruno stepped down as Senate Majority Leader and on the last day of the legislative session, the state Senate passed a union-backed bill banning non-compete agreements in New York State .The state Assembly passed similar legislation last year. The bill now moves on to the Governor’s desk for final approval. In a last ditch effort to stave off such legislation, the NYSBA and a coalition of opponents are planning to meet with the Governor’s staff to discuss the bill. Several other states have already passed such legislation, including California, Illinois, New Jersey, Connecticut, Massachusetts, Arizona, Wisconsin, West Virginia, Maryland, Iowa, Missouri, North Carolina, Oregon and Washington, D.C. to mention a few.

I don't think this will affect things too much. You don't see too many non competes in radio anymore. Your top show hosts MAY have one...but it's nothing like in TV. Every reporter, anchor, sports and weather folk must sign a non compete.

Makes you wonder if you'll see anyone leaving their current station and going to the highest bidder.

In some cases, even producers and other top off-camera positions (lead director, etc.) are signed to non-competes. I certainly hope it goes through.

Right now, if you want to try to get a substantial pay hike, or if you want to keep working after being fired or laid off, you're stuck moving to a different market. That's not a big deal if you want to go to bigger/better markets. But it's a horrible situation if you want to stay in the area for family or other reasons. Obviously, a Syracuse station can't match a salary offer from a Dallas or Boston station. But you CAN try to match a better offer from another Syracuse station. And if your boss says no, you can take the new job, and you don't have to go through the hassle of finding a new residence, moving, notifying everyone, etc. And when your first boss realizes what they've missed, they can pay you even MORE to come back.

Stations like non-competes because they are like a security blanket for them to keep their best people. But on the other hand, without non-competes, stations also have the power to steal away the best people from the competition. The downside (for stations) is that they WILL have to open up the checkbook in order to retain their best people AND to lure in the best employees from the competition. But that's just like any other business where aggressive recruitment is required. Broadcasting's been getting a free ride, and it's time for that to end.

The non-compete is a stupid policy and it should be done away with. How the heck are you suppose to better yourself and grow in your career when you can't even move around in a market. I love how CC holds a gun to your head when you want to improve your life and move onto something different. Of course they have double standards, and throw around the non-compete policy only to the employees they like...or the ones they don't want to lose. Selfish twits!

CC's non-compete agreement is very well written. It's an all encompassing contract meant to scare it's employees from even trying to leave. It was still beatable before the new non-compete laws.
