Now that the contract has expired...

Now that the contracts between the hosts of WEEI's AMD team and Entercom appear to have expired, does Entercom/WEEI/Nassau have the legal right to use their names or likenesses for advertising or promotional use?

How can they sell the D&C show to sponsors when they are no longer employees?

Same with the ad buys in the Boston papers.

If I were a lawyer siding with D and/or C, I'd order a 'cease and desist' on any further promotion of them or their likenesses until and unless a new deal is signed. Clearly this is hardball between the two sides, and the folks at Entercom might want to 'take a walk on a beach and reflect' before a court order is slapped on them.

Why would they want a cease and desist unless they've signed up somewhere else?

To get such an order from a judge, they would have to demonstrate that any promotion on 'EEI was harming them in some way. In fact, it's probably not harming them at all.

Isn't this similar to what Entercom did (or did not do) with Howie Carr? They let the contract lapse and there was an agreement to 'extend' the negotiating period. When Howie wanted to go elsewhere, Entercom's Wolf had his now-famous glass-throwing 'We-Had-a-F'in-DEAL!' tantrum. Well, no, there was no 'deal.' There was just them stringing Howie along and getting PO'd when Howie called their bluff.

So is this Entercom-Carr redux? Same church, different pew?

Carr is a different situation... He is still an employee under contract, and although it is disputed and heading to litigation, there is an extension option in Carr's contract.

So if Carr walks on the 19th, Entercom could stilll promote him claiming the one year contract extension, but I think that Carrs legal team would be seeking an injunction 30 seconds after the first promo ran.

As has been noted elsewhere, WRKO is still running employment spots for radio time sales rep; included in the announcement are refrences to Tom Finneran and Howie Carr.

Well if the rep started monday, sold a spot at 10, got it approved at 11, rushed into production at 12, the could put it on instead of those PSA's they seem to be running a lot of lately

" ...WRKO... Getting it said for Boston"

Do you think there might be some unsold inventory? PSA's im PMD?

So they start running the spots on 9/10 that leaves 8 whole days of the Howie Carr Show left, now the question is how many of those days will Howie be there?
