If the FCC can't even keep up with all the actual flaming pirate radio stations everywhere, what the hell makes ASCAP/BMI/SESAC think their handful of snitches can enforce their rules on somebody's iPod transmitter?

Businesses are one thing (and only if you're in the entertainment/restaurant/bar business where the general public frequently gathers. Where music (live, karaoke, jukeboxes) are openly offered.

And I can't begin to count how many play music anyway (for DECADES) regardless of legal issues.

Just send of them in a biker bar to see what I mean.......
