Party 101.5 translator question

I notice that Party 101.5's transmitter site is located on the edge of Party 105.3's 40 dBu contour (the signal is so weak there that 101.5 sometimes translates WDAS during tropo). I was under the impression that a commercial station can't own a translator outside its protected contour. If so, how come JVC can broadcast PartyFM on the 101.5 translator?
