Regarding the proposed music performance tax thing...shouldn't that open the door both ways? If a major artist is doing a radio station a favor by allowing the station to play his music to the degree that he should be paid, shouldn't that radio station be allowed to charge a fee for the promotional benefit an emerging artist gets for the airtime? Seems like the performance tax would render the spirit of existing payola laws obsolete. To my understanding, the main reason a payment for play is illegal is because that play is supposed to be free, but once a dollar value of that play is established, shouldn't the free market dictate which side of the transaction is receiving the greater benefit?
And, if such a system were to develop, wouldn't it be an even wash for radio, as we would just pass to the superstar the money that the new guy paid us for airtime?
