my point is that 3 drinks in 5 hours cant get a 200 lb man above to the legal limit. the body processes a drink per hour, so the BAL of everyone who went along with the format of the party should have been at or near a .0. I am sure the math there is confusing to all the girl scout troupes returning from camp to McKinney Ave at 11 pm on a Wednesday night.
I'm not sure anyone has established if he had a few or no drinks and was dealing with an overzealous officer (who perhaps heard him say X-mas party and got out the cuffs) or if he indeed did something inappropriate. My point is nobody here knows what happened. That is why a judge will review the evidence and give a ruling. At which point appropriate action will be taken. Until such time, I hope the rest of you enjoy your stay in Salem.
I am in no way advocating drunk driving and firmly believe that everyone who is drinking should walk, take a cab, or use a designated driver. Anyone who does drive under the influence should be thrown in Lake Lewisville. If they float they are guilty. If they sink, then they were sober.
