I meant to say, 'end your programming run a legal ID, not turn off the transmitter and still be legal.

I'm not an attorney and I don't play one on TV but I think you MUST give a legal ID every hour, as close as possible to the top of the hour.
I've never heard of an Atlanta station cited by the FCC for an unmodulated carrier in the 30+ years I've been around.
 
OK, let's look at section 73.1201 even closer.

"hourly, as close to the hour as feasible, at a natural break in program offerings."

Suppose there is no programming? Say you end your programming at midnight but don't drop the carrier. There are no program offerings since there is no programming. According to this, you don't need to run a legal ID.

I'm not saying there is no legal requirement to ID the station. I also felt like a station that had a carrier up needed to ID. However, after seeing the FCC not fine or reprimand a station for not doing so, I started to wonder about the rule myself. In fact, I had a friend at the Powder Springs FCC office once tell me they would listen for a station not to ID, then target that station for an inspection if they didn't since, in his words, if they can't so something as simple as a legal ID, chances are they have other things they are not doing.
 
The ONLY time a radio station is required to be "turned off" is if it is causing interference or jeapordizing public safety. The "legal id" is required every hour of a station's broadcast day, but the station does not have to sign off if the legal id is not played. The station could be cited for not giving it's legal id, but it does not have to remove carrier because of lack of programming.
