i confess, i haven't heard a word... haven't tuned in to philips for weeks, and i don't get XM (yes, i am a sirius fan... but i get the mx channels free w/dish net) i am getting the gist of the situation... that O&A claim their bit was ripped by Philips, and Philips is milking O&A's reaction for mentions about him on their show... obviously to attract their listeners to tune in to his show via XM. This is calculated and an old radio stunt. Philips was never very good at pulling off DJ style radio stunts. my question is, what is the point of "going to management"? does he want corporate to pursue some copywrite/trademark, or what? and what exactly is the media bit/stunt itself that O&A say he stole?? is he sending out some grunt to pull off something a la stern w/ stuttering john as news reporter for CBS radio ... or what? i admit i am out of the loop on this one, i don't have opportunity to listen to more than the last half hour. On a regular basis the show just isn't listenable, especially jim and moira and those newer clowns. the only bright spot on that show is Jack. too bad, i loved the Libertarian Philips,which originated on WKIS years ago, and continued up until Ms. B left and Moira took over in 1997. (geeze, was that really almost ten years ago?) ever since he became some flaming liberal i've lost faith in him, he's abandoned the logic that made him so compelling. He is no longer able to support his positions with facts, he can only attack another's opinion that doesn't agree with his.

O&A would ask fans to go out and sit in front of live news shots. The fan would hold a sign and/or yell "O&A XM 202" or the like. O&A's intern was doing that when Arthur Chien of NY, reporting on a news story, turned around before the live shot ended and yelled "What the F**K is your problem, man??"
Philips discussed using a stunt(slightly changed from O&A's) and claimed he had to clear it with management so he could make it his own and no one could rip it off. This drove O&A wild because they have been doing this for a long time. They never claimed "ownership" of the bit, but when Philips never mentioned them, giving them any form of credit or nod, they went ballistic. On 7/20 Philips openly proclaimed he (like other DJs) has stolen material for years and used it on his show.

The copywrite/trademark issue is a cease & desist Philips put out so O&A could not use recordings of Philips' show on O&A's show.
 
I never listen to either show anymore, but if that account is accurate, then O&A are being jackasses... jocks/hosts steal bits all the time, and making a little change to make it their 'own' is more than anyone can ask. Nobody ever gives credit for a bit, and nobody can claim ownership of a bit. I'd like to hear O&A give credit for every little idea they've 'stolen' from some other show *cough*stern*cough*.

O&A are stupid to think Philips owes them anything.

Thanks for the update... we all know that radio is full of recycled material... but the stunting behind a reporter is definitely an old bit... its just been pulled off the shelf, freshend up a bit and then re-introduced. its no different then kids you see behind a local TV reporter doing a live stand-up. They're waving, making goofy faces and yelling, all the while the reporter is ignoring them and trying to keep from loosing it. remember John 3:16? you'd see that goofball holding that sign at EVERY freakin' televised sports event... the name of the game is to be even more outrageous then the last guy. as for O&A calling out Philips, sounds like jim may have baited them with his comments on doing a stunt, in an attempt to get them to mention him. its a standard under-dog trick to attract listeners from the higher rated show to tune in to the lower rated show. O&A would do better to ignore him. Jim won't refer to O&A on his show so as not to clue his listeners into the competition. of course philips has more listeners in orlando due to the terrestrial broadcast, but on XM, no doubt O&A are much more popular. they were better known nationally anyway due to the WNEW fiasco with the Sam Adams promotion and the sex in the cathedral bit. Heck, I remember when they were thrown off (WAAF?) in (Worcester?) MA. that's what got them the gig on WNEW.
