Radio and Eminent Domain

I wouldn't be surprised to see WGNZ (licensed to fairborn but towers in Xenia across from Wal-mart)become an eminent domain victim. Place has to have four listeners, I can see them wanting to remove an eysore and continue developing back there. Then again, there'd be protests about "silencing the voice of God".

***If the area has been opened up to strip development then yes, it is quite possible it eventually could become a target. There's no question a strip center or shopping mall is going to generate far more tax revenue for a city than a radio station sitting in a few acres.

On a bright note, a TX Representative by the name of Corte is proposing a Constitutional Amendment to overturn this ruling and ban the practice of taking private property by government only to turn it over to a private developer for a for profit non-public use venture.

I'm sure I'm going to get blasted for saying this, but it seems to me that this dude isn't exactly all there upstairs... From reading his posts on this topic so far, he comes off as one of those "the government is out to get me / is spying on me / is hiding aliens" types of people. Look buddy, if you think that the community finds your programming offensive, then tweak it a bit to "get the man off your back." If you think that "they" are going to use eminent domain against you, get a lawyer. It's that simple.

Assuming you're running this out of your home, I wouldn't think it would be an eminent domain issue, but whether or not your home is zoned for business.<P ID="signature">______________

***Precisely why I have not made a move yet. I've been in my present location for a year but I have not even run my station. No problems with the local government like in the small town in NY State. No zoning issues here but the place is simply too small to be able to generate a minimal amount of revenue.

Anything is possible now in a state that does not have laws to protect citizens private property. If you've heard about the guy trying to start eminent domain proceedings in New Hamster on David Souter's property then this clearly illustrates that it can be used to single out someone who's fallen into disfavor with the local government.

I am doing a ton of research before making another move. I don't need any more small town problems. Kentucky prohibits this type of eminent domain as do a few other states like Maine, Virginia, Washington and South Carolina.

The New Hampshire item is an effort by an activist to draw attention to the issues and to stir things up. Clever idea, mind you, but not an serious attempt to create a development.

I was trying to be subtle. Given the issue originally raised was a legal issue, I figured I would bite and play the game.
