Ive always wondered.. What about these "big named" broadcasters that are using hooks of songs in their music sweapers? I always heard that this was a "no no"

Also what about those that are using clips from tv shows etc (homer saying "doh" etc) in their production, isnt this a grey area?

Dan O'Day has a great dissertation you can buy for a few bucks on his website. It has a great 3 page handout for your staff that's concise and to the point. Great for salespeople who get requests from clients for hit music in their spots, althought salespeople still promise things that can't legally be done. In case you think copyright owners won't come after you, our stations are involved in a lawsuit over a spot sent out by a regional agency. The coopyright owner is suing the agency and every station in the state that aired the spot. This all started around 3 years ago, before I came to this cluster, so you can see that a lot of time and legal bills are already involved. In the past month we have had 2 clients actually cancel buys because I, as Production Director, told them that we would not air their spots with copyrighted music in them. Fortunately my management team backs me up strongly in these matters. My biggest problem is the Clear Channel cluster that constantly uses copyrighted music in and under spots that they send to us. Stuff can get buy me. For example movie soundtrack stuff that I've never heard. Agencies can also do odd things. They can buy rights to outtake versions of songs that are almost identical to the actual hit versions, but it's difficult to determine if they actually have proper clearances. Oh well, keeps the job interesting. Maybe you'll see me on Judge Judy someday!
