Have you ever heard of an owner who claims his stations play only music in the public domain?

Well, meet Ken Jones, owner of KXEZ and KHYI. Jones made just such a claim to ASCAP this year.

His nose is growing and growing ...

Jones is running for Rockwall County Judge after running third in a field of three for reelection as Rockwall mayor.

Imagine, for example, claiming that KXEZ which plays The Beatles, The Rolling Stones, etc., is playing music that is in the public domain.

Believe it ... or not ...

As I understand it, the music is obviously in the public domain, but the arrangements of such music are copyrighted.

You are correct. You amy look no further for example than the film "It's a wonderful Life" Many stations played it over and over and often competed on that same night with it during the holidays in the 70's and 80's. Finally in the late 80's Republic Pictures (yes they were still around,though changed quite a bit) found out they had the MUSIC SCORE rights to the movie. They went to court and stopped the showings on many stations,then licensed it to NBC.
Classical compostions are mostly public domain BUT the arrangements,the symphonies,conductor are NOT. So WRR must report like any other station.

On Ken Jones,He is not well liked by many in Rockwell.IF he is elected county judge it would be because no one was strong enough to have run against him.

KXEZ needs to change up their music at the :25.:35.and :55 breaks. They play the same old songs at those times. Question is why? Why not play a psa, or better yet sell the time? Even better,stay with the network. The mornings with Hal Mayfield ( and I have high respect for him) should talk a little faster when doing the traffic reports. He keeps missing the marks and rejoins ABC when a song is either halfway over or just finishing. Finallythe sports promo needs to change.dave Campbell keeps talking about the "holiday season"and for "everyone to have a joyous Holiday season".

I'm having a bit of trouble reconciling this posting with reality.

I don't know much about KXEZ -- the signal doesn't reach my stomping grounds at all, and besides, aren't royalty payments tied to ratings? Anything multiplied by zero...

But KHYI is a different case altogether. Their ratings may not be phenomenal, but they're enough above zero that I'd think they'd be noticable. Plus, they don't play oldies -- in fact, their alt.country mix is more current than any of the "mainstream" stations, where it's currently all "Jesus, Take The Wheel" all the time. KHYI is a large fish in the small alt.country pond, so I'd think if they're skipping their ASCAP payments, someone would be showing up to knock on the window of the Plano studio.

Radio may be a business that eats its own young, but politics is another thing entirely. With the elections coming up tomorrow, I just can't take seriously anything posted -- on this forum especially -- that attempts to link the two.

Of course, even if I lived in Rockwall County, I wouldn't be voting in the primaries. I'm saving myself for Kinky! (see www.votekinky.com if you're scratching your head)

Well, seeing is believing, as they say.

So if you want to see a copy of the ASCAP letter, then let me know.

And the letter goes beyond the payments, Jones wants a refund of payments already made since he claims both stations play music in the public domain.

In addition, as I understand it, Jones was $27,000 behind in payments to ASCAP.

Hey, I want to see whatever I can. Though the whole thing begs the question -- how, exactly, would you *have* a copy to show me?

If you worked for ASCAP, you'd be collecting the money, not talking about it in a public forum.

If you worked for the station, you'd be pretty stupid to air its dirty laundry, even here at Dirty Laundry Central. Even if you'd already quit, it doesn't seem like a good career move -- "hey, hire me, I'll rat you out in a heartbeat!"

That leaves a couple of other options. One, you're just making it up. Two, you know someone at the station and managed to get some dirt on the guy. Politics again -- love that mudslingin'. But you know what? I don't think it'll stick.

My KHYI-Fans -at- yahoogroups.com email list, where fans discuss the ups and downs of KHYI as well as their terrestrial (KFWR) and satellite competition, doesn't seem to care one way or the other. I posted the original note, expecting to get a discussion going, and it pretty much fell flat. The one response so far says, in effect, that ASCAP/BMI screw over small act anyway, so who cares?

Like I said, I wouldn't be voting in the primary even if I was in the county. And I have issues with Jones' "More roads!" campaign -- you can't build your way out of gridlock, but you can sure look busy trying. But if someone's hoping to turn this small potatoes business dispute into a campaign issue, they may be surprised -- with the record companies going after grandmas and preteens, anyone who sticks it to 'em looks like a modern-day Robin Hood.

Actually, I don't really care if I work in radio again. Ken Jones is unfit to hold public office or own a radio station. That is what it is all about.

The letter is signed by Hugo R. Del Bove, radio accounts manager and dated November 1, 2005.

Here is a portion of the letter:

"the station's website clearly advertises Goodtime Oldies KXEZ-FM @92.1 "Your home for hits from the 50s, 60s and 70s"

I do not understand why you would believe that music from this period would be in the public domain."

Well, the stations and listeners would care if the owner fails to live up to his contract with ASCAP and BMI. Because that would mean he would be unable to air copyrighted music.

You're a little mixed up. These payments to ASCAP go to the author or composer of copyrighted music works.

If you do not pay your ASCAP or BMI fees, you are stealing from the artists.

And you ought to work for the guy. No employees -- contract labor even though nearly everyone works regular hours.

Translated: Department of Labor violation.

No benefits -- none -- not even vacation.
