Rush screws radio stations?

It appears that Rush Limbaugh may have put radio stations "across the fruited plain" in legal jeopardy with his "Two If By Tea" promotion that ran on Friday. He was saying that anybody who bought a case of his tea ($23 + change) by midnight would be entered into a random drawing to win a year's worth of the tea for free. Looking at the O.A.B. guidlines I believe he has violated state and federal law concerning the advertising of lotteries. You have the 3 elements of a lottery: Prize: a years' worth of tea. Chance: a random drawing. Consideration: you have to buy a case for close to 24 bucks. His website claims that he will make a donation to a Marine Corps charity which is a 501-C-3, but does not state that all proceeds/profits will go there. It appears that this is not strictly a charitable enterprise and that Rush and his friends are making a killing for themselves with this tea. Stations could have someone facing 6 months in jail and a fine of not more than $1,000.00. We'll see if anyone complains to the proper authorities or not. Also, some stations run Rush's "Week In Review" over the weekend and there's always the possibility that this program will run again further complicating the matter. Your thoughts???

As long as there are casino ads on Ohio radio stations, i think we are safe to assume that these affiliates will be okay.

I know that there are certain "no purchase necessary to win" type rules. I don't see a big problem here.

That is the key. If there isn't a way to be part of the contest without consideration then there a problem.
 
In Ohio at least, state lotteries and casino ads are legal as long as you follow the rules, which are too goofy to list here. Same with Texas hold 'em tournaments as long as the proceeds all go to a 501-C-3 charity. The "no purchase necessary" rule covers a lot of ground but that by itself won't get you a pass on all contests that are lottery style promotions. It can get messy.
