Can someone explain to me how some services get by with unlimited skips on a statutory soundexchange license? I have not actually read the DMCA document, but I have read numerous times that services using the statutory license cannot offer more than 6 skips per hour. Yet several do and the RIAA has never complained. Doesn't make sense. Especially since some have been publicly stating it and using it as a competitive advantage versus Pandora. I also don't understand how they can afford it since the royalties are supposed to be paid on every song, skipped or not. Am I missing something or is the industry just that broken?
