Sinclair Jumps the gun in pulling it's Tubes (re: WGGB and E/I)

I just read over on Scott Fybush's site that Sinclair has pulled "the Tube" from all it's DTV substations because of new rules regarding E/I. I was able to get the Tube on WGGB & WTXX. I haven't checked WGGB in some time as I have my antennas set up for the most channels I can get at one time, this leaves me without WWLP & WGGB. I'll have to move one of the antennas to see if they have anything on the 40-2 when I get home.

However, I did notice on WTXX this weekend that the tube was showing some E/I content and I saw a "The Tube" bug in the corner, so I guess maybe Sinclair jumped the gun?
 
WTXX-TV/DT is owned by Tribune Broadcasting, not Sinclair.
 
I know, I bring up what I saw on WTXX, suggesting that the sinclair stations might not have needed to drop the tube.
