SiriusXM $28M Do Not Call Lawsuit Settlement - Are They Doomed?

Under the terms of the proposed settlement, SiriusXM will provide a fund of $28 million from which eligible class members can receive cash payments. The settlement fund will first cover attorneys’ fees, administrative costs and service awards for class representatives before pro-rata distributions to eligible claimants.

This is a company that is already paying Howard an insane amount of money every year for little product. So could the $28 million settlement be considered chump change, or are employees - particularly at their call centers - at risk of losing their jobs?

The settlement funds aren't the question. The question is whether SiriusXM has agreed to terms in the settlement that limit their telemarketing. If so, the number of telemarketers will be reduced.

People don't get paid to drink coffee at telemarketing firms.

I’d love a law that stops all telemarketing.

Not necessarily. The suit sought to limit the way they did telemarketing, specifically violating "do not call" registrations. There are many other ways that SiriusXM can market their services. While that may involve less use of the phone, the company is not going to stop trying to get customers to renew or past customers to return as well as trying to get as many new car buyers to sign up as possible.

FYI SiriusXM has a market cap of $6.85 billion. Most beneficiaries don't file for the money they're entitled to receive.

In answer to your question: Chump change.
I'll bet that the legal costs exceeded the settlement. Many if not most of those class action suits benefit only the originating law firm.

In the last four or five years, I have gotten notices about being "potentially eligible for a share of..." from at least six different such class action suits. In each case, the settlement looked like less than $20 and involved trying to find evidence of using, buying, subscribing to or otherwise buying something. Not worth the effort, so I did not fill any of them in.
