SiriusXM Reaches Settlement in Pre-1972 Royalties

After reaching a settlement over royalties for pre-1972 recordings in June, 2015, only to have blocked by Flo & Eddie (The Turtles), SiriusXM and attorneys have finally reached a settlement before it went to trial in California this week. The attorneys for both sides submitted a joint notice with the court. The Turtles duo had sought an injunction for the previous $210 million settlement.

The Turtles duo claimed that the settlement reached after the challenge made by Flo & Eddie was an effort to interfere with the class-action process declared last year by a California judge in the case. They wanted funds to be deposited into an interest-bearing account under the court's control. In May, 2015, a U.S. District court approved class action status for the Flo & Eddie suit in California for unauthorized airplay of their music.

A settlement deal was reached in June, 2015, with Sony, Universal and Warner along with independent ABKCO Music & Records.

A check of XMFan's Audio Library Search shows that the Turtles are still banned on '60s on 6. I assume that will change soon. I also noticed that Deep Tracks managed to sneak in lone spins of "You Showed Me" and "She's My Girl" earlier this year. I wonder how much XM brass had to shell out when the Turtles' legal eagles screamed "Gotcha!"
 
And I wonder how much the subscription price will adjust now that their royalty payments have to include this earlier music.
 
Is it my imagination, or does SiriusXM's crack legal team have a lower success rate than Charlie Brown kicking a football with Lucy holding? Seems that every time SXM tries to push the envelope legally, either the courts rule for the other guys or a settlement has to be reached.

I agree...and perhaps some of it comes from operating a regulated monopoly. They feel they can't be as hard-handed as other companies for fear that it invokes the monopoly charge that could lead to a break-up.
