Would I be wrong to assume that Stern gets as much publicity out of being sued by CBS as CBS does? Lets fact it anything that gets peoples minds off WCBS-FM and WNEW has to be good for CBS right? It all seems like such a game to me. I saw Stern on Lettermen (via TiVo I'm behind in my TV watching). I would think if CBS was really after Stern they wouldn't exactly want Lettermen to invite him on The Late Show. Dave and Howard seemed to be having too much fun with it all.

Stern and Sirius absolutely benefit from the press given to this situation. I'm not so sure that it's a battle that CBS will want to air publicly, though. While they claim Stern used their airwaves to promote his upcoming Sirius gig, Infinity, Viacom & CBS laughed all the way to the bank! If they were so
"damaged" by Stern's year + of Satellite "hype," they had the power to pull the pug on him at any time. Outside of a one day suspension last fall, they failed to do that. They'll hardly be viewed as "sympathetic" by a jury if this goes to trial.

It's a pretty safe bet that the general listening public probably doesn't know or care that they are responsible for all of the stations mentioned.

Kinda looked like a replay of Stern's appearance on Letterman's NBC Show in 1985, when both were employed there. That visit was recreated in Stern's bio-pic "Private Parts."
