As my tort law professor once said, waivers and disclaimers are there to dissuade the naive.
If you are the licensee of WXXX, and a brokered programs uses indecent or obscene content and you broadcast that content, the disclaimer does nothing to help you--you're still held liable for that broadcast.
In the case of defamation, the disclaimer will keep away those who don't know much, but legally it isn't protective on its face. But, keep using them...if nothing else, the do "dissuade the naive".
