Talk Show Disclaimers

Does running a disclaimer before a talk show protect a station against any actions that could be taken against them? Or is doing such merely just an added protection that really won't protect a station? By disclaimer, I mean something to the effect of: "The following program does not necessarily reflect the opinions of the staff, management, ownership, or sponsorship of W---."

Thats my guess.

add: "its more than likely our opinions, unless we get into
some serious do-do from a runaway host."

I think some stations that run The 700 Club do.

As my tort law professor once said, waivers and disclaimers are there to dissuade the naive.

If you are the licensee of WXXX, and a brokered programs uses indecent or obscene content and you broadcast that content, the disclaimer does nothing to help you--you're still held liable for that broadcast.

In the case of defamation, the disclaimer will keep away those who don't know much, but legally it isn't protective on its face. But, keep using them...if nothing else, the do "dissuade the naive".

How much those medical-based talk shows? They have a disclaimer claiming that the views and opinions on these shows are not a substitute for doctor's advice.

I've heard disclaimers stating that the show is NOT live and not to call-in at anytime.<P ID="signature">______________

Translation of all of the above disclaimers:
"We take their money, no matter what they advertise"

Same with law shows: it's to disavow any liability for malpractice should anyone foolishly follow medical or legal "advice" for free.
