Talk shows on AM/FM and satellite

I'm curious if this is something the NAB or the terrestrial stations are going to protest this in the near future. Currently you can listen to your favorite syndicated host on your local radio station, BUT you could also listen to him/her on satellite radio anywhere if that person is carried. Television stations protested this similar practice with cable back in the 80s with the rise of WGN-TV and WTBS, and the new syndex laws were created to protect syndication exclusivity in local markets. Now, the same thing exists with satellite radio, except there is no syndex protection. What may make satellite more appealing is if your local market has the show on delay while satellite has the show on live, or simply in a more convenient timeslot. I remember when I lived in Atlanta, people were calling Dave Ramsey's show listening on XM's Talk Radio 165, which aired the show live from 3-5 PM (tape 5-7 PM), while WGST ran the show on delay from 7-10 PM, which was frequently preempted by the Braves.

Syndicated Exclusivity (Syndex) has nothing to do with satellite tv. It's just used to protect a local market station if a cable system tries to import a TV signal from an adjacent market. Programming is separately licensed to so-called superstatons like TBS and WGN.
