Now that JP has successfully taken back the frequency, the next question becomes "What about the web domain?" From what I understand, Citadel has ownership of the domain www.wnoxnewstalk.com They are currently using it in conjunction with News/Talk 98.7 FM. But since the domain contains "WNOX" which they no longer have control of, can they continue to use the domain?

(I don't know the answer, so I'm asking those who are more knowledgeable than myself in this subject.)
 
With all of the good will flowing back and forth, especially through this venue, I am certain there will be an open and amicable exchange. This will happen in the form of flying pigs. Keep your eye on the sky!

Citadel can definitely continue to use it until a decided lawsuit says otherwise.
 
Citadel can continue using the WNOX even though they do not have use of those call signs anymore. Wouldnt that be some sort of false advertising?

Citadel owns the domain name same as 100.3 owns the call sign.

Except in this case, the name is not held by cyber-squatter as it has been defined in court to date. Citadel can choose to allow a change in registrant, or they can choose to keep it for as long as they want to do so, unless they are successfully sued. However, what most stations/companies do is just look for a variant on the name and avoid the hassle, time, and expense of the lawsuit. Once the new site is advertised, it is a moot point anyway. Now if Citadel comes back and advertises wnoxnewstalk.com as the site for News Talk 98.7, rather than just own the domain and keep quiet about it, then you've got a definite problem that you can far easier take to court.
 
According to case law their use of the URL is not allowed. They should just show they are honorable and surrender it to the actual WNOX.
 
Citadel is promoting 987NewsTalk.com as their website. I'm sure the new WNOX has domains registered. Is there a case quite like this in case law?

The topic of this thread "wnoxnewstalk.com" is the direct "pointer" or domain to/for the current 98.7 website.

There are several cases with similar situations which were settled in favor of the plaintiff (owner).
 
It's settled apparently. www.wnoxfm.com. according to Ed on the air a few ago. Pretty smart move. If they decide to flip it to country, oldies or whatever, if they stick with the calls (and I'm sure Mr. Pirkle will) then you don't have this "domain name" problem again. Amazingly, from what I can tell, everything they've done with the "New 100.3 WNOX" seems to indicate they are here to stay! I love it!
 
Interesting line-up of guests this morning. Mention in another post of good ones this afternoon. With 40 years of connections (and a sidekick with 30 on his own) there ought to be a steady stream of 'em.
