That came in its reply to Comcast's June 8 response to Liberman's April 8 program carriage complaint.
In a filing June 7, Comcast told the FCC that Liberman Broadcasting's (LBI) program carriage complaint related to the MVPD's dropping of three TV stations fails on three grounds: 1) As a broadcast network (Estrella TV), Liberman is not authorized to bring a carriage complaint, which is confined to cable networks (Comcast's negotiations were instead covered by must-carry, retrans regime); 2) Comcast's request for digital distribution rights as a condition of carriage is not a demand for a financial interest in Estrella; and 3) the complaint was filed beyond the statute of limitations.
LBI argues that it has presented "clear and compelling evidence" that Comcast discriminated against Estrella TV to favor its Spanish-language networks, Telemundo and NBC Universo, including by "unlawfully" demanding digital rights. It claims Comcast is in violation both of program carriage rules and NBCU deal conditions.
In its June 27 reply comments, Liberman said nothing Comcast said changes the fact that there is a "clear" case for a full FCC hearing.
It said it clearly meets the definition of a video program vendor eligible to bring a complaint given that Estrella TV produces most of its own programming. It also said it remained clear that Comcast "unlawfully required LBI relinquish the digital rights to its own content as a condition of carriage."
And while Comcast said it had simply made a reasonable decision not to carry the network and that it was not related to favoring its own nets, Liberman said that didn't wash, either.
"Comcast’s treatment of Estrella TV does not reflect a rational commercial negotiation," it told the FCC, "as evidenced by distribution agreements Estrella TV has in place with every other major MVPD in the country. Only Comcast has refused to reach a fair deal to carry Estrella because only Comcast owns two competitor networks.

Bay News 9 is owned by.....Bright House (now Charter)...so I doubt there would be a dispute when both the system and the channel are owned by the same people. That would be like Comcast yanking USA, SyFy and Bravo from the Comcast systemsWhat about cable networks, like Bay News 9, which is only on Bright House. The rule with satellite and PBS seems to be if they (PBS) can get a good signal to the POP then it can be carried. That was the issue in Minneapolis DMA where there is technically 5 PBS stations. KTCA & KTCI in Minneapolis, KWCM in Appleton (about 150 miles from Mpls), KAWE Bemidji (about 200 miles away) and WHWC in Menominee, WI. Even though WHWC serves Eau Claire, their license is in Dunn County which is the eastern part of the Mpls DMA. They gave up their "must carry rights" for Minneapolis. KAWE got a fibre connection from their satellite station in Brainerd to Minneapolis to be carried back in 04 (Mpls launched in 99 with Big 4 and the rest did early 02) and finally upgraded to HD early 2015. KWCM came aboard on Dish and Directv in early 2015. They talked about the money and the hoops to jump through to carry itAlthough I have never heard of a PBS station being in a dispute with Dish until today, which was when KENW-TV in Portales, NM, was in a dispute with not only them, but Nielsen, because they want to stay in the Albuquerque market instead of the Amarillo market and says that Portales may have lost them on satellite if Nielsen moves Eastern New Mexico to the Amarillo Market. Why stay in ABQ? Because most of KENW's translators are in New Mexico and not in the Texas Panhandle. Thankfully, Dish, Direct, and Nielsen listened, but they still moved it to Amarillo anyways, but later moved it back to the ABQ market and they left the Portales area alone from that point on.
Dish is about to get into another dispute, this one with Meredith.

Since the markets are only like 35 miles apart from each other, hey we'll just tune into the other market...oh wait...other than ABC that can't happen
One good thing about Hartford and Springfield: Those markets are small enough (in area) that an indoor antenna would work in many areas of each market

What's next?! Dish in dispute with the NBC O&Os (WVIT) and/or Media General/Nexstar (WWLP/WFXQ Springfield and WTNH/WCTX)?! The whole Hartford/Springfield market will be mad about this, as they can't watch anything local other than the PBS stations?!!
Dish might as well go out of business, since they put almost whole market off the air. If someone could afford to, they (if they live in Connecticut or Springfield, MA) should have a lawsuit against Dish as Hartford soon may be the largest market to have all it's Big 5 (CBS, FOX, CW, NBC & ABC) stations go off the air on Dish because of it's disputes (WTNH and WVIT should watch out)! Dish viewers are very mad and disappointed in Dish as in Hartford, it may soon provide NO local channels, even though Dish says there are.
Well, the only local channels there that are safe is the Spanish stations and the PBS stations (PBS stations are almost guaranteed to be immune to disputes). 3 disputes at 1 time (Tribune, NFL Network, and now Meredith) This is outrageous Dish, your subscribers in CT and west Massachusetts are enraged that they can't get their local channels, except for PBS stations, CPTV and WGBY.
Makes me glad yet again that I have DirecTV.![]()
