U.S. District Court Of Appeals Denies Net Radio Stay

The U.S. DISTRICT COURT OF APPEALS has denied a petition submitted by a number of webcaster associations for an emergency stay according to the SAVENETRADIO coalition. [EDIT]

So Let Me Ask You This Question: Do all broadcasters have to pay these people, including commercial, and non-commercial AM's and FM's. Everyone pays right, no one is exempt? Right?

No, AM/FM's currently don't have to pay (although SoundExchange and A2IM are trying to change that) and Satellite Radio pays at a rate that is far less than Internet Radio. You'd have to ask your Congressman why.

It's unfortunate that people around the world will not be able to access a myriad of formats that they cannot get anywhere else. I have been associated with broadcasting for nearly 40 years and just last year launched two of my own Internet radio sites. Through my monthly fees to the service provider (Live365) I have paid the necessary royalties for both. This is a hobby and I make zero income from either station. It appears that the music industry wants to bite one of the hands that feeds them. I received an email from the CEO of Live365 that informed us Internet broadcasters that Live365 has no plans, at this time, to allow these changes to affect their broadcasters and will give us due warning before anything goes into affect in order for us to make the decision to stay or shutdown. I hope something can be worked out. It's especially difficult for us who don't make an income from our Internet stations.

The RIAA/SoundExchange is already trying to do that through illegal lobbying of Congress and a self-created splinter group by trying to skirt the law. The other couple of threads on RIAA/SoundExchange activity have the links to the story on Wired covering this topic.

I also shot a note to Kurt Hanson of the Radio and Internet Newsletter to see what he can drum up on the topic.
