VERY ODD "Beverly Hillbillies" on COZI

This morning San Diego NBC 7 launched COZI and managed to catch the "Beverly Hillbillies."

It was very strange that the theme song music was NOT the usual "Beverly Hillbillies" theme song ("Come and listen to a story about a man named Jed, A poor mountaineer, barely kept his family fed,") but rather a generic bluegrass music bed. Also, the production values on the episodes (featuring Bea Benadaret) were terrible...not what I've been accustomed to...

Any ideas? Does COZI/NBC not have the sync rights to the more familiar "Beverly Hillbillies" theme or syndicated episodes?

I was able to answer a part of my question (which is included on IMDB's Beverly Hillbillies page) http://www.imdb.com/title/tt0055662/trivia :

"The entire first season (all 36 episodes) as well as the first 19 episodes of the second season are the only episodes in the public domain. The 20th episode of the second season to the end of the series are still under copyright protection. These 55 episodes ended up in the public domain because CBS, having bought the rights to the series shortly after its cancellation, neglected to renew their copyrights. As a result, these episodes have been unofficially released on home video and DVD on many low-budget labels. In many video prints of the public domain episodes, the original and much-loved theme music has been replaced by generic music due to copyright issues."
 
NBC programming their secondary channel with public domain DVD's bought at Walmart.

Heyyyyy now....a lotta decent stuff in them thar dollar store DVD's!

I cannot receive RTV at this time, but when DX is good, I see it out of the Orlando station. Their retro Saturday mornings are a treat. Much of the Filmation cartoons, some originally on CBS, ran only 26 minutes, including commercials*, because of CBS' "In the News" features back in the day. So, RTV fills in the gaps with old Dick Tracy or Mr Magoo cartoons or other shorts.

*If there are any programs originally on ABC, there was Schoolhouse Rock, so again there are gaps to fill.

They're broadcasting only Christmas episodes for The Beverly Hillbillies during Christmas Eve and Christmas Day after that they'll yank The Beverly Hillbillies off their schedule.
 
I have noticed similar situations with opening theme music being replaced with something else. Especially when watching reruns via Netflix. Once that come to mind is that Married With Children's original Love and Marriage by Frank Sinatra has been replaced with an instrumental sounding similar to the original.
Another is Charmed which replaced "How Soon Is Now" by Love Spit Love with an instrumental that is completely different. It amazes me how difficult it is for the copyright holders of the DVD distribution can't get the original theme songs to go with them. Could you imagine classic shows like The Flinstones or MASH without their original opening themes? Neither can I.
 
This is nothing new. ABC affiliate KTGM/Guam have been running public domain episodes of "the Beverly Hillbillies," "The Lucy Show," "The Green Hornet," "You Asked For It," and "Robin Hood" since 2009 as filler on their weekend schedule. This was done because they used to fill whatever timeslots they had with encore airings of ABC primetime shows like "Ugly Betty" and "Desparate Housewives" but had to discontinue it, probably due to ABC asking KTGM to stop doing so. This was also the same thing and reason with sister station KEQI and their affiliation with Fox.

In Canada, the French language stations play a generic opening theme for the Flinstones. The first time I heard it I was all ???

That's not generic. It's the regular Flintstones theme sung in French.

The issue is that, for many older programs, NO ONE saw the secondary market in online distribution and DVDs. Therefore, many music licenses during the period only allowed usage of the songs for broadcast purposes - including second-run syndication (this is why, for example, Married With Children includes the original theme on syndicated and cable re-runs, but not on the DVDs or Netflix). The use of the music on DVDs and online requires a separate licensing arrangement, which can prove costly; when the margins for such releases are slim to begin with, it is often more economical to replace the music with a generic piece of music rather than negotiate and pay out a costly licensing fee.

From what I understand, recent productions should not have this problem, as current licensing arrangements include provisions for ALL distribution channels, both current and future.
 
I have the "TV Classics " two DVD set of the "Beverly Hillbillies" which has the instrumental theme instead of the Flatt and Scruggs theme.

I'm very surprised that the shows on TV are with the non Flatt and Scruggs theme.
