Vitter Threatening Radio Stations With Lawsuit

I think the Vitter campaign is digging themselves a hole by threatening radio stations with legal action over his opponent's ads. That tells me his campaign is in trouble. As far as I know, radio stations are not allowed to censor political advertising and they get the lowest ad rates to boot. Thats why political ads can get so nasty. Can't stand the heat, Vitter? Then get the hell out of the kitchen.
 
Agreed. Can you imagine if EVERY target of negative political advertising took this strategy?

Maybe political ads should be outlawed. Make the candidates knock on doors/otherwise mingle with the people they are (allegedly) representing (keep Vitter away from the hookers...gee, wonder if I'll get sued for that?). Short of that, shouldn't the political rates be 'market', rather than 'low rent'? Might keep the content on topic, rather than on attack.

True:
Section 315 [47 U.S.C. §315] Facilities for candidates for public office.

(a) If any licensee shall permit any person who is a legally qualified candidate for any public office to use a broadcasting station, he shall afford equal opportunities to all other such candidates for that office in the use of such broadcasting station: Provided, That such licensee shall have no power of censorship over the material broadcast under the provision of this section. No obligation is hereby imposed under this subsection upon any licensee to allow the use of its station by any such candidate. ...

By my reading (I'm an engineer, not a lawyer) stations cannot edit the campaign ads of Mr. Vitter's opponent(s) and cannot refuse to run them. UNLESS...

they refuse *all* campaign ads for that office, including Mr. Vitter's.
