WCAP 980 Lowell owners heading to court....

LOWELL -- A clash over who runs WCAP radio has its primary partners heading to court.

The station's general manager and majority owner, Clark Smidt, has filed a lawsuit in Lowell Superior Court against shareholder Sam Poulten, alleging that Poulten has placed the station in financial peril.

Poulten declined to comment yesterday, but his attorney, Scott Bratton, alleges it's Smidt who has put WCAP in jeopardy. Bratton said he plans to file a countersuit today, including a motion of preliminary injunction to remove Smidt from the daily operations of WCAP. The station broadcasts at AM 980.

"Smidt's attorney, Richard McClure, said his client has made every effort to reach an amicable solution without dragging the matter into a courtroom.

"He refuses to do any revenue gathering or sales," McClure said of Poulten. "Clark has 45 years of experience in the business. Sam is a real-estate broker. The only way the station is going to be financially solvent is with Sam stepping down."

Smidt declined yesterday to elaborate on some of the allegations against Poulten, including previous legal action that court documents state "call into question (Poulten's) ability to properly and publicly represent Merrimack Valley Radio."

Whenever I tune in to WCAP, they're playing a Beatles recording. Even for people who like the Beatles, it seems to me to be to be a bit much. It's difficult for an AM station to build an image these days (see: WNSH); but if there's no consistency, they're starting out swimming upstream. Oh, that reminds me...gotta get some salmon cat food for my cat.

The name of their automated "oldies" format, which plays whenever they aren't airing a news, talk, information or sports program, is "Beatles and Before", implying pop music that was out during the career of the Beatles (early '60s to '70), a little from "before" (mid-'50s to early '60s), and a LOT of Beatles in the mix, something like four Beatles songs per hour.

It's smart, and consistent. If you're going to appeal to the demographic that likes '60s pop oldies, you generally can't go wrong with the Beatles.
