All Access is reporting: In other filings with the FCC, WINGS COMMUNICATIONS, INC. is donating Talk WELE-A (GOLIATH RADIO)/ORMOND BEACH-DAYTONA BEACH, FL to BETHUNE-COOKMAN UNIVERSITY

What a strange recent history. Anyone know all the details?
 
Bethune Cookman already owns a LPFM - can a non-profit(?) own an AM and a LPFM?
 
Actually, they can. There's a loophole in the LPFM rules that allows a college/university to hold both a student-run LPFM and a professionally-run full-power license.
 
Let's see…the last two renewal applications are pending, the owner is in bankruptcy, a trustee is appointed—can he legally donate the license? I guess he can. What happens to Goliath that has been running the thing?

My guess is Wilhite is donating it as part of the bankruptcy filing in hopes the Commission approves that transfer. Then B-CU will be able to get the renewal. That will then open the way for Goliath to purchase it from B-CU. I'll bet they'd like the money instead of a station that needs a lot of work to transmitters, phasor, etc.
 
I'd be surprised if a bankruptcy trustee would let that happen. A station in Pittsburgh sold out of bankruptcy for $14k. If they won't approve this Goliath as an owner now they aren't' likely to approve him later either.

I guess the question I'd ask whiplash is whether he approached the current owner with an offer, or the trustee...
 
There is also a license renewal that has been pending since 2004. The FCC will not approve a license transfer to anyone when a license is pending renewal which has been, among other things, the main hold-up all along. Once the license renewal is approved, then the FCC will approve the license being assigned to a qualified buyer. In all probability the license will be renewed now that it is being donated to an institution of higher learning.

Just to add to the situation, Wings filed bankruptcy but apparently failed to notify all its creditors to the bankruptcy. Seems like there are a ton of problems here.
 
What I Don't understand is if they've been unlicensed how are they on the air? Why doesn't the FCC come and shut it down.
 
I did make an offer Parttimer. And because they didn't feel the FCC would transfer the license, they declined the offer.

WELE is not operating unlicensed. It never has operated as an unlicensed station even though the license expired in 2004. WELE is legally authorized to operated with its expired licensed because Wings Communications filed for a license renewal before the expired licensed expired. Because the FCC has not acted on the renewal application, yet, WELE remains technically licensed.

Seems I also read somewhere,though it is one of those things where you can't find it when you want to refer to it...about the commission in a similar case very recently to the WELE/BCU situation said a school could not own a non-comm and a commercial station at the same time.

A school, college or university may own an NCE and commercial station simultaneously. In fact, a not-for-profit group may own as many NCE-FMs and NCE-TVs as they want provided the channels/frequencies are available and the school can show to the FCC it is in the public interest. And while a for-profit entity may not own any NCE stations, a not-for-profit entity may own both although a not-for-profit entity is subject to the same local ownership cap rules regarding commercial licenses as a for-profit entity is required to follow.

By way of example, in Gainesville, the University of Florida owns the following stations:

WUFT-TV 5 PBS (NCE-TV) Gainesville
WUFT-FM 89.1 NPR (NCE-FM) Gainesville
WRUF-FM 103.7 (Commercial) Gainesville
WRUF-AM 850 (Commercial) Gainesville
WRUF-TV 10 (LPTV) Gainesville
WLUF-FM 90.1 NPR (NCE-FM) Inverness
New TV 39 PBS (NCE-TV) Crystal River
