- (Accuser) tells the prosecutor in June, 2011 to drop the charges because she will not testify. (She knows she must challenge the arresting officer who testified for the defense about changing her story on the stand)
- (Accuser) hires an attorney to bar her from meeting with the prosecutor and off the stand in a second trial.
- Prosecutor files motion to only submit the transcript of accuser's testimony in second trial. Prosecutor claims "victim is too traumatized to testify in front of a jury".
- (Accuser) is arrested on Halloween weekend, 2011 in possession of a loaded weapon outside her home with a male co-defendant. (the co-defendant is witnessed threatening another man with said gun.) The police find gun on (Accuser)
- (Accuser) testifies in front of a grand jury for gun possession and is not indicted. (We believe she testified against he co-defendant for immunity)
- Jan. 11, 2012 - Judge Maxwell Wiley rules if prosecutor can be allowed to submit transcript of accuser's first testimony. Keeping her off the stand.
If Judge Wiley rules with the defense, the accuser must take the stand. (We believe the accuser's attorney will fight the DA's office about her taking the stand.)
